The 2 scenarios that could have obligated DVLA to accept mediation of any kind are that (a) DVLA did not adhere to contract bid practices and procedures or (b) a mutual settlement that allows some at DVLA to pay monies to the presumed aggrieved party that initiated the lawsuit to settle out of court with the potential for kickback money to be paid to some at DVLA (which I very much doubt).
The case as it originally unfolded shows there's no court and judge that would rule against the DVLA. The exception maybe that the current contract between the DVLA and current manufacturer of license plates has not expired per contract or at worst the DVLA engaged in sole sourcing this time around without prior notice and invitation to the current license plates manufacturer to submit a bid if it chose.
If, on the other hand, DVLA can pay off the amount left on the current contract and happens to know that the current license plate manufacturer does not the wherewithal to meet the new plate specifications and therefore not invited.
So while it may be tragic for a local manufacturer to lose out to foreign competitors, it is also true that there are inherent dangers to sustainability of the uniqueness of the new license plates.
