The judges who overturned the ruling of the Tamale High Court know what justice is about. As for the one who varied in opinion, it was expected. If Kpandai must rerun, the presidential election must also rerun because the whole Ghana is one constituency of the presidential votes. If the few uncounted votes, insignificant to affect the outcome of Kpandai parliamentary election, invalidate the MP then the president must also step aside for a rerun. It has always been the case in Ghana that in a situation where destroyed votes are not enough to change the outcome if all the votes were added to the candidate with second highest votes, the candidate who gained the highest votes shall be declared the winner. Any other decision contrary to this is a political one whether it comes from a party or a court! In the worst case, only the polling station where the votes were destroyed is eligible for rerun, not the whole constituency. And if that was done the outcome would be the same, unless there was vote rigging. So why waste state resources?

This Kpandai case and ruling is more of the Biblical King Solomon-esq type ruling with implications down the road for the NPP, the NDC and the EC.
The justices who voted to quash the ruling by an appellate court did so not because of who appointed them to the SC but because of strict interpretation of the law regardless of the wrongdoing of EC and lies of the NPP. The 4 justices arrived at their conclusion and correctly so because the Tamale court did not have jurisdiction to hear the case.
The lone dissenting vote came to his conclusion with foresight and historical perspective and caution. Knowing that the NPP team lied about the date the results were recorded /published and the complicity of the EC, the justice chose to resolve the issue now.
The ruling pushes to a later date and a possible major conflict to come if such allegations are repeated elsewhere by either party with EC complicity.
