Seeking a late injunction to stop an arranged contractual funeral service in the UK- and anywhere in this world can have significant financial consequences, primarily involving substantial legal costs, potential liability for the funeral director's losses, and a potential order to pay the other party's legal fees.
Significant Financial Consequences
High Legal Costs: Injunctions are notoriously expensive, especially urgent, last-minute applications which often require out-of-hours legal work. Legal fees for solicitors and barristers can quickly run into thousands or even tens of thousands of pounds, depending on the complexity and urgency of the case.
Court Fees: There is an initial court fee for filing an injunction application, typically around £500.
Adverse Costs Order: The general rule in English litigation is that the losing party pays the winning party's legal costs. If your application is unsuccessful or the court decides it was without merit, you could be ordered to pay the other party's (e.g., the person who arranged the funeral or the funeral director's) legal fees, significantly increasing your financial liability.
Cross-Undertaking in Damages: The court will typically require the applicant (the person seeking the injunction) to give a "cross-undertaking in damages". This means that if the injunction is granted but the court later decides it should not have been (e.g., at a full trial), the applicant must compensate the other party for any losses sustained as a consequence of the delay or cancellation.
Contractual Liabilities: The person who signed the contract with the funeral director is personally liable for the costs incurred. Stopping the service late may constitute a breach of contract, and you could be held liable for any cancellation fees or costs for services already rendered that the funeral director is entitled to recover under their terms and conditions (e.g., costs for the coffin, preparation of the body, venue hire, etc.).
Other Potential Consequences
Irreparable Family Damage: This type of hostile litigation is highly sensitive and can cause long-term, irreparable damage to family relationships during an already difficult time of grieving.
Contempt of Court: If an injunction order is granted and you or any third party with notice of the order deliberately disobey its terms, it can result in serious penalties, including fines or imprisonment.
Given the significant costs and the sensitive nature of these disputes, the court often encourages parties to attempt mediation or a compromise. It is critical to seek specialist legal advice immediately to weigh up the risks and options available.

Since when did they file for the injunction. Will the injunction be filed if that crook Abusuapanin listened to Lumba's immediate family members and included them in the decision making of his funeral. That Abusuapanin 's own brother and 2 or 3 immediate family members are in the morgue as we speak. Why doesn't he concentrate on the funeral of his own brother instead of insisting on burying Lumba he wasn't even on speaking terms with while he was alive if his main goal is not reaping money from the funeral?

Herrrr, Ghana! Oooh no! This is not fair!! Our justice system is seriously warped. It seems to me that this latest decision is an afterthought or after some strings have been pulled from behind. What is the judge afraid of? Doesn’t he have a mind of his own? How are they going to cough up this amount within this limited time? This shows that the whole funeral is about business and not to mourn Daddy Lumba. I believe some unauthorized people, possibly from the now defunct funeral Committe, want to cash-out some ineligible expenses before it becomes too late. I suggest the immediate family kicks out every person who has a hand in the previous funeral arrangements, including the controversial, dishonest and confused Abusuapanyin Tupac, if they are able to deposit the required amount. After all, it serves as a hedge to indemnify those funeral contractors against any loss. They are in it for business and not to mourn, they must be kicked out immediately.

Seeking a late injunction to stop an arranged contractual funeral service in the UK and anywhere in this world can have significant financial consequences, primarily involving substantial legal costs, potential liability for the funeral director's losses, and a potential order to pay the other party's legal fees.

This high court judge is an idiot. His rulings has rather complicated the case. How does he expect the other litigants to cough up two million cedis within two hours ? This completely nonsense. We can’t be doing things like we live in an uncivilized society and fighting over dead bodies. This case is not a civil one to be settled in court . This is for our traditional chiefs and elders to apply wisdom in the judgments . When it comes to the inheritance of properties that is where our civil courts are engaged to settle matters in the absence of a legal will . The late Lumbar does not deserve this because of the joy he brought to people through his music.

This high court judge is a scum bag . How will he give two separate rulings on the same case the same day . That was a mixed signal and very confusing which did not make any sense at all. Even local elders could not have given this stupid judgement. Even if the judge wanted the other party to pay for the funeral expenses incurred by Tupac before he could place an injunction on the burial, how on earth could he demand a payment of two million cedis within two hours ? It does not make sense to even a fool . Some of these judges have given rulings on cases that have tarnished the image of the judiciary as a whole . It is time for the judicial council to review every rulings from these judges to see the validity of some of these senseless decisions. The judiciary has a tarnished image already since Anas documentary on them and they must do the needful to reclaim their respect and integrity.
