NPP operatives are being dragged to court for crimes they have (allegedly) actually committed. Let the courts decide their guilt or innocence. Sure, the hands of the NDC are not cleaned either; however, it's the job of the NPP to prosecute those if they come to power and care about the country.

I agree that crimes have to be prosecuted irrespective of one's political alignment, but it's a country in Africa we are talking about here. NDC should be free to prosecute, recover stolen assets, and jail the offenders--even if they are all NPP. THE NPP can do likewise if they return to power. We should be serious as a nation for once.

Martin Amidu’s assertion that the President and Attorney-General have “weaponised” the Economic and Organised Crime Office (EOCO) lacks evidential support and legal basis. Providing printers to EOCO constitutes lawful administrative cooperation, not political manipulation, and does not breach the 1992 Constitution or the Economic and Organised Crime Office Act, 2010 (Act 804).

When former Special Prosecutor Martin Amidu alleged that EOCO had been “weaponised” by the President and Attorney-General to target political opponents, the claim attracted significant public attention. Amidu’s reputation for integrity and anti-corruption advocacy is widely acknowledged. However, as he understands legally, reputation cannot replace evidence. Serious allegations of institutional abuse require concrete proof of interference, selective targeting, or directives from the Executive that undermine statutory mandates. No such evidence has been publicly provided, rendering the assertion speculative and potentially damaging to public confidence in institutions responsible for upholding the rule of law.

EOCO was established under the Economic and Organised Crime Office Act, 2010 (Act 804), to investigate serious economic and organised crimes. The office is overseen by a Board and operates independently from the Attorney-General’s Office. The 1992 Constitution of Ghana, under Article 88(1), designates the Attorney-General as the primary legal adviser to the Government and the supervisor of public prosecutions. While this provides broad policy guidance and coordination responsibilities across the justice sector, it does not grant operational control over EOCO’s investigative activities. Administrative support, such as providing office equipment, is therefore a legitimate function of inter-agency cooperation rather than a form of political interference.

Much of Amidu’s criticism relates to the Attorney-General’s recent provision of printers to EOCO, which he sees as an attempt at coercion or influence. Legally, there is nothing illegal about this. EOCO can receive equipment or logistical support from government departments or ministries under Act 804, especially when it improves operational efficiency (see ss 4(2) & 10 of Act 804). The Attorney-General may lawfully provide such support but is not legally required to do so. Without evidence linking the supply of printers to directives affecting investigative outcomes, the action is administrative, lawful, and impartial. Ghanaian administrative law recognises that the legality of a state action is determined by its substance and effect, not by public perception. Supplying office equipment cannot reasonably be seen as “weaponisation” of an investigative agency.

Ghana’s Supreme Court has affirmed that administrative acts are presumed lawful unless proven otherwise. To establish political misuse of EOCO, it is necessary to demonstrate selective enforcement, explicit directives to pursue or avoid investigations, or interference in the operational independence of investigators. None of these elements have been substantiated in Amidu’s claim. EOCO routinely investigates politically exposed persons as part of its statutory mandate; this fact alone cannot be taken as evidence of political targeting. Treating all investigations involving opposition figures as politically motivated undermines the principles of equality before the law and institutional independence.

Academic commentary indicates that, despite criticisms and challenges, EOCO is currently operating in line with its legal mandate. Norman notes that although EOCO faces systemic issues, it is actively investigating serious economic and organised crimes within its legal responsibilities: “Despite this mandate, EOCO appears to have lost the ability to police the economy … [but] they continue to operate within the scope of their powers to fulfil their statutory obligations.” This suggests that EOCO is working to fulfil its duties lawfully, and reports of “weaponisation” are not supported by evidence of interference with its operational independence.

Freedom of expression permits public critique of government actions; however, such freedom carries a duty to ensure accuracy and fairness, especially within legal contexts. Publicly claiming that EOCO has been “weaponised” without verifiable evidence risks damaging institutional credibility, discouraging professional integrity, and fostering public distrust. When credible evidence of interference emerges, institutions such as parliamentary committees, the Commission on Human Rights and Administrative Justice (CHRAJ), or the courts have the constitutional authority to investigate, request documentation, and hold entities accountable (Arts 218–220, 286). Neglecting to highlight these mechanisms reduces public debate to speculation, which is both legally and ethically problematic.

Martin Amidu’s dedication to accountability and anti-corruption is commendable. However, his claim that EOCO has been “weaponised” because the Attorney-General supplied printers lacks both factual and legal support. Administrative backing is lawful, does not undermine EOCO’s independence, and cannot be deemed political coercion. Ghana’s democracy thrives when public debate is rooted in evidence and law rather than conjecture and emotion. Justice and accountability are achieved through proof, not perception, and until specific acts of interference are proven, EOCO must be allowed to carry out its statutory duties free from politicisation.
