So can a Justice in supreme court who misconduct, charged and found guilty and removed then says , can still be a judge in the High Court or Court of Appeal because he or she sweared an oats in High Court to be a judge which is separate from the oat he or she sweared at to be Justice of Supreme Court. Example, Supreme Court Justice steals money and caught which is misconduct. The Justice is charged, found guilty and sacked from Supreme Court. Then the Justice moves back to the High Court to be a Judge. Note, every level of the Judicial steps, you are swears in .

As we develop our democracy or rule of law, it is constitutional interpretation and enforcement that will help us develop the law to guide us in the future.

The former CJ is entitled to all the rights enshrined in the 1992 constitution and principles of rule of law.

The AG has done the right thing by referring three issues to the Supreme Court for interpretation by properly invoking the original jurisdiction of the apex Court under article 2 and 130 for the proper interpretation of some provisions in article 146 of the 1992 constitution.

The interpretation of these provisions in article 146 will now become law.

In the case of NPP v AG (31st December Case), the rule on the " spirit" of the constitution was developed to indicate that there could be unwritten provisions of the written constitution which are enforceable.

In the matter of Margaret Bamful v AG, (GITMO 3 Case) the Supreme Court ruled article 75 requires parliament to ratify foreign agreements, treaties,conventions to domestic such documents to conform with our municipal laws.

We should all remain objective in this matter.

While she remains CJ, and yet the petition is against her JSC's position, who would the President direct the petition to determine a prima facie?

Since the Constitution says the CJ in this instance is the one to determine the prima facie, would she expect to sit on her own case or recuse herself for the President to appoint an acting or substantive CJ to deal with the petition?

When a President's rendered permanently incapable according the Constitution to discharge his duties and the VP assumes the position and role of the President, does he still retain his position as VP, so that even if he becomes impeached in accordance with law, he can roll back to his former VP position?

● Her removal from the office of Chief Justice is a demotion; so she can return to her position on the Bench as a Supreme Court Judge.

Imagine someone steals cassava or goat, the person can be jailed for up 10 years in imprisonment, but someone took the state’s money to pay per diem to her family members and Ghanaians are crying why she was removed from position. Whichever way you are removed, you are removed as a Superior Court Judge. Article 146 (1) states the precondition or prerequisite for the removal of a Superior Court Judge. Though, there are different procedures or processes for a Supreme Court Judge and a CJ, once removed you are no longer a Superior Court Judge. So, it's trite or simplicita to note that when removed as a CJ technical means you can't stay as a Supreme Court Judge. SIMPLICITA
