Now, back to the subject matter of the former CJ's removal, and it is preposterous for any rational-thinking person to assume that the removal of the CJ does not affect her position as a Supreme Court Justice. I judge.
In the first place, was Madam Torkono appointed to the position of CJ in her capacity as a Supreme Court judge or was she appointed to that position as an individual? The truth of the matter is that the NPP and thier assigns are allergic to the rule of law, especially when it is against them. This explains why they threw away thier party constitution in the run-up to the 2024 general election just so they could remain maintain their majority status in parliament.For, they're exhibiting the same thing in the matter of the removal of the former CJ. This kind of behaviour smacks of dishonesty and unprincipleded character on the the part of the npp6.

As the Chief Justice, Madam Torkornoo was the head of the Judiciary. Why would she be dismissed summarily and asked to retain her position in the same organisation she was removed from? Even on resigning she would not maintain any position in the organisation how much more being dismissed.

I don't know why some people use the law say things that aren't logic. How can someone be fired as an MD and then this same person comes back and asks to be assigned as district manager. It's like firing a head master and later putting him or her in a classroom. How would he or she feel working in this capacity, this is a demotion.

I am not a lawyer and don’t intend to be one though I can’t predict the future but common sense makes it clear that, she assumed the position by dint of being a Supreme Court Justice. She wouldn’t have been appointed CJ if she hadn’t been a SCJ in the first place. Just like a teacher appointed headmaster wouldn’t have occupied the role without first being a teacher.
When such a headmaster is dismissed, it doesn’t pave way for him to return to the classroom to teach unless the person is demoted.
MADAM TORKORNU to me and those misinterpreting the constitutional provision seem to misconstrue the key word “REMOVAL,” to mean “DEMOTION” which is a clear mistake.
She became a CJ because she was a SCJ and being a CJ could be referred to as being elevated or appointed a step further from the previous position. When you’re removed from office it’s automatic removal from ever playing a role as a judge whatsoever.
There’s therefore no ambiguity whatsoever. Just like the IGP was changed and not made to assume back any other role in the service as a commissioner of Police because he had extra years to serve before retiring, so also the CJ can’t return to the bench. The difference however is that, the former IGP goes with his benefits as nothing was established against him except for the fact that the appointing authority deemed it necessary to change him unlike the former CJ whose position is cemented as the only cause of removal could be based on stated misconduct, incompetence, bias, etc and that could be done through constitutional process which had been fully explored

If one is removed as JSC, there's no way one can be appointed as CJ thereafter. A petition to remove a CJ from being JSC cannot succeed because CJ will be judge against him-/herself. So petioners could not have used that route, but it is implied. Do we want to waste resources to duplicate the exact same process of doubly humiliating someone?
