This is no longer the case now. The Supreme Court has ruled in Martin Kpebu vs Attorney General that a surety can not be given jail time if a bailee absconds.

It is more or less like defrauding the owner of the landed property without his consent. That is why he was sentenced to 14 years imprisonment. If it had been a normal granting of surety, he would have been given either 6 months or less. So it was his fault.
