The president and CoS do not need to determine any prima facie case. If they try to, what will the committee to be set up by the president do? The committee will definitely go into the core of the matter and if it's frivolous, they will dismiss it.
This CJ bought the problem for herself as she wanted to please Akufo Addo and the NPP.. A case in mind is the Afenyo-Markin (the Kasongo) and the Speaker. If SALL, for four years didn't have representation, why is it a problem for NPP constituencies not to have representation less than two months to general election? Look at the e-Levy, lgbtq and the Domelovo cases, this witch and a bitch wasted time just to make the determined case moot. She must go and allow a more unifying CJ to be appointed.

Whoever advised the President to take response from the CJ prior to the establishment of the Prima facie case, iill-advised the President. Per article 146, CJ’s response will only needed at the committee that will trial the case should prima facie case is established. It is at the committee level that the CJ would be asked to respond to to the prima facie case established in the petition . The framers of the constitution want the prima Facie case to established independently without any response from the person who is the subject of the petition. This is because until prima facile case is established, the petition remains a hear say and does not warrant any response from any person. The reason is that no prima facie, no case and therefore no response from the person who is the subject of the petition.The question now is, is the Council of State going to determine the prima facile on the basis of C J’s response or what?. The philosophical underpinnings of Article 146 is weakened by this action. Emotions overtook Law here.
