Justice Douse and Oliver-Barker Vormawor are the scanty few I have heard criticizing malpractices and corruption in our justice system. Majority of Judges and Lawyers (over 99%) including the so-called human rights lawyers will never admit the huge
flaws in our justice system. This is because the Judiciary and Courts in this Country are basically run by a cabal of very corrupt judges, lawyers and associated staff who gang up to gag cases and stifle litigants with very good cases which they should naturally win in Court. There is a difference between criticism of the judiciary and the courts by lawyers or Judges either for personal parochial interest or political
expediency and criticism genuinely borne out of concern by judges and lawyers bold enough to indeed point out the injustices in our corrupt justice system. The judgement in favour of Anas which was unanimous ruthlessly exposed the inadequacies and naked corruption in our Courts considering the size of the jury. Many like Anas have been robbed in our Courts with very bizarre
and silly judgements in cases which such Plaintiffs should absolutely win without question. Suppression of suits and circumvention of justice in favour of the rich and powerful are very much a common feature of our Courts. Unfortunately, when corrupt judges who do everything possible to frustrate victims of injustice at the behest of powerful villains in our Courts are reported,all that
the apex of the judiciary and organs of the
Judicial Service of Ghana does is to rather swiftly
act to conceal such malpractices and illegalities in
the Court. The stark reality is that the chance of a
Plaintiff with an absolutely good case winning his
case against a public institution of State, a high profile politician or public servant or a rich business man in Ghana is mathematically zero because you will have the whole judiciary set-up, the Office of the Chief Justice, the General Legal Council, the Court and your legal representative ganging up to frustrate and oppress your case in which your case docket will lye down, rot and die in the Court to be thrown out. The reason for this is simply because we normally have persons appointed as Chief Justices who are corrupt,politically inclined and chose to do the bidding of the Government who appointed him or her. Unfortunately, majority of public sector
corruption cannot be solely blamed on politicians
but corrupt public or civil servants who hide behind institutional structures and systems to perpetuate
malpractices and corruption related activities
against the State for selfish gains. In the end they find a way of using the same State to conceal graft through the AG Department. All that the top politician or public official(s) do is to look for a
corrupt and bribe prone State Attorney to lobby and
compromise the Judge and, or the Legal Representative of the Plaintiff to give you a raw deal
and literally squeeze your case out of Court. When the Plaintiff is daring enough to report a Judge or
Lawyer for malpractices or violation of the law, the same State Attorney who have a close working relationship with the General Legal Council or the Office of the Chief Justice as institutions under the same Government and associates of the Ruling Political Party will simply come together to block and suppress the beleaguered Plaintiff or Litigant. This particular phenomenon of the whole justice system activated to feign, fight off and kill cases of Litigants or Plaintiff become more profound when the suit is against a public institution, a government organization with public officers and politicians of
the ruling class involved. Even if a Chief Justice appointed by the Government may not be corrupt, the corruption industry which is a powerful entity in Public Service will force the Chief Justice into corruption and malpractices to safe its sanctity. This is where the Chief Justice will begin to look at issues with a political lens and directly interfere with cases against the State or the Government of
the day to whitewash the Government usually
because of pressure by either the President himself or
other high profile government functionaries to turn the case against the Plaintiff or Litigant, if he or she is particularly perceived to be a political opponent or anti-government. Anas for instance like many other litigants was never going to win a case in the Courts of Ghana especially with the previous Regime because he was perceived as anti-NPP and against the NPP Government. The Judiciary was at its Lowest ebb and corruption in the Judiciary hit an unprecedented crescendo under the Nana Addo Government despite the now Ex-President being touted as a renowned Lawyer and Human Rights advocate. Admittedly, the Judiciary and Courts in Ghana are traditionally corrupt as already stressed but real moral decadence and total collapse of our justice system incidentally and unsurprisingly was under Ex Prez Nana Addo. All that Nana Addo did was to pack the Superior Courts of Judicature with political loyalists and NPP Judges, appoint Getrude Torkorrnoo as Chief Justice to take total control of organs of the Judicial Service of Ghana including the the Courts, Office of the Chief Justice and the General Legal Council to essentially capture the Judiciary arm of Government under his wings to fester the corruption agenda of his friends and family government. If there was one reason why the rescue of the State became paramount, fortunately with a resounding NDC victory led by HE John Dramani Mahama, it was because of happenings at the General Legal Council(GLC) under Nana Addo.The GLC besides being used as a political tool to intimidate, threaten and victimize lawyers perceived to be members or loyalists of the then main opposition NDC, it was also the hub for covering up endemic corruption and malpractices in public institutions in suits against government organizations and officials, ranging from abuses of fundamental rights, freedom, dignity of citizens including security threats, suspensions/dismissals from work, financial embargos, suppression of economic rights among others in typical political vendetta. I am extremely happy with the reforms at the GLC by the incumbent Mahama Government with the nominations by the Minister of Justice, Dr. Ayine made in the persons of Lawyers Sosu, Clara and Abdul Bassit to the GLC. We need such intelligent, innovative and incorruptible young lawyers to be at the GLC in place of very old ones like Lawyer Sam Okudjato who have outlived their usefulness and were part of the pervasive corruption, naked politics, favouritism, vindictive tendencies and general indiscipline, inefficiency at the GLC which significantly contributed to the breakdown of our justice system. What is the use of the GLC if lawyers are reported for gross unethical behavior, unprofessional conduct including serious violations of the law such as contempt and sometimes overt criminal acts such as extortion, bribery, deliberately sabotage or undermining a Client in favour of an opponent for selfish gains without punishment? Anas badly exposed the endemic corruption in our justice system to international ridicule for the second time with a resounding victory with his defamation suit in the States against Mr. Agyepong, one of the powerful and rich politicians in Ghana. Indeed, the real measure of Democracy and Rule of Law is when the Justice System and the Court is bold to rule against the rich and powerful in favour of the poor and powerless. Of course, Anas on relative basis is not powerless in anyway that is why he was able to file a suit in the USA to clear his name when our bias and corrupt Justice System circumvented and denied him same because he was already a target by the Judiciary and the Court with his ruthless expose' of endemic corruption in the Judiciary and Courts in Ghana. But I am very sure if many vulnerable, poor and powerless people as victims of judiciary corruption in Ghana at the behest of the powerful villains with the affluence and influence to manipulate judgement pronounce by Judges in their favour, to win through the backdoor with irredeemably bad cases, were to be heard in the USA, most of the corrupt and manipulated judgements against them in Ghana, will go in their favour in the USA. In Ghana, we know those who fight corruption like Anas become potential victims because the corruption industry fiercely fight back anti-corruption Crusaders. The very President Nana Addo who made an open declaration of fighting public sector corruption using Anas Principle was the one who witch-hunted and persecuted key Investigative Journalists in this Country including Anas himself. Ex-President Nana Addo also became the doyen of public sector corruption in the fourth Republican dispensation with unprecedented corruption and institutional malpractices under his watch by the end of his tenure. Anas's victory should be celebrated as a national victory for the many citizens and CSOs against corruption and social injustice but cannot directly confront the canker for fear of retributive justice. Indeed, Nationalistic and Patriotic citizens like Anas with the financial resources should fight such retributive justice with the same zeal as Anas, to directly confront the corruption industry and its operatives. In the whole of the fourth Republican dispensation, the most promising government showing good signs of political will and commitment to fighting public sector corruption is the incumbent John Mahama Government, judging by the actions and inactions of His Excellency, the President and I hope that continues, to encourage Citizens to rise up against nation wreckers who are always quick to blame politicians alone, when majority of culprits are actually with the public or civil service including workers of the Court and Judiciary like Judges.
