QUAYSON AND ANOR (1989-90)1GLR 147, SARBAH, J.M. in his book" FANTI CUSTOMARY LAWS(3RD EDITION) at page 41etc.Therefore,with or without legislation, marriage by cohabitation is recognized by Ghanaian courts as a valid form of customary law marriage entitling a spouse to the estate of his/her deceased spouse like in any statutory provided marriage. In almost all the above cases, the consent of the respective families or the performance of marriage rites is a mere ratification of the marriage agreement and held as desirous but not a condition precedent to the creation of a valid customary law marriage. So i don't really see what the A-G is worried about.

Do we have a side chick marriage or a co-habitation marriage? Why do you want to encourage wayward behaviors as marriage? Sides chicks are always paid off by those who take them, some side chicks even enjoy better than the wives, children born outside marriage are still the responsibility of their rightful fathers. Spouses should divide properties they contributed to the marriage upon breakup not the one already acquired by the other. Upon death of the other 50% should go to the surviving spouse and kids whilst remaining 50% should go to the deceased family. We shouldn't entertain side chicks.
