Your concerns about justice and accountability are valid, especially in cases involving serious crimes like murder. However, the administration of justice must always adhere to the rule of law to ensure fairness and prevent misuse of power. Here are a few points to consider:
1. Admissibility of Confessions: While the defendant may have admitted guilt, the law requires that such confessions be verified as voluntary and corroborated by evidence before they can lead to a conviction. Justice cannot rely solely on admissions without ensuring due process.
2. Role of the Jury: The jury’s role is to evaluate the evidence presented in court and determine guilt beyond a reasonable doubt. A split decision indicates that the jury did not unanimously agree, making it legally and procedurally impossible to deliver a definitive guilty verdict at this stage.
3. The Importance of Fair Trials: Regardless of the crime or public sentiment, a fair trial is crucial. This protects the rights of everyone, including the accused, and ensures that justice is delivered without bias or error. Punishment without due process risks undermining the entire judicial system.
4. Common Sense vs. Rule of Law: While “common sense justice” may seem appealing, the law exists to prevent subjective decisions that could lead to unfair or inconsistent outcomes. The rule of law ensures that justice is based on evidence and legal principles, not emotions or personal opinions.
Your frustration is understandable, but justice must be balanced with fairness, evidence, and proper procedure. Ensuring that the law is followed protects both victims and society as a whole from arbitrary decisions.

Generally speaking, most Ghanaian lawyers and judges are per se illiterate.
The requirement for unanimity applies only to a guilty verdict. That is to say that where the verdict is not unanimous, as in this case, the defendant should go free and the jury discharged. A discharged jury is different from a hung jury. A jury is discharged after a verdict is arrived at. A hung jury cannot take a decision and is therefore dismissed. And a case may be retried only after a hung jury.
A unanimous verdict of guilt is required in all criminal trials, or else the defendant goes free.
This judge is illiterate in criminal law, and this anomaly should be cured in the next 24 hours.
The defendant should be released as soon as possible.

The argument regarding the requirement for unanimity in criminal verdicts is noted; however, under Ghana’s Criminal and Other Offenses (Procedure) Act, 1960 (Act 30), a split verdict allows the jury to be discharged without leading to an automatic acquittal. The judge’s decision to order a retrial is legally permissible and aims to ensure a fair resolution of the case. While the presumption of innocence is fundamental, a split jury does not equate to a conclusive finding of innocence. Allegations of judicial incompetence overlook the judge’s adherence to the legal framework, and any perceived errors should be addressed through appeal rather than generalized criticisms.

Thank you for your thoughtful question and willingness to learn. Here’s a clarification:
A 4-3 decision is considered a split decision because it reflects disagreement among the jurors rather than unanimity. In criminal trials, unanimity is typically required for a conviction, meaning all jurors must agree that the evidence proves guilt beyond a reasonable doubt. However, a split jury—such as 4 voting for guilt and 3 for innocence—does not meet this standard, nor does it result in an automatic declaration of innocence.
Instead, the legal outcome of a split jury depends on the procedural rules of the jurisdiction:
• In Ghana, under the Criminal and Other Offenses (Procedure) Act, 1960 (Act 30), a split decision leads to the jury being discharged, and the judge may order a retrial if the case is inconclusive.
• While a defendant is presumed innocent until proven guilty, a split jury does not equate to proof of innocence—it simply means guilt has not been unanimously established.
This process ensures fairness by providing another opportunity for the evidence to be fully considered. Your curiosity and dedication to understanding these principles are commendable!

This is a total shame. If such a prominent personality like an MP could be brutally murdered and a so-called court of competent jurisdiction would take 8 long years to complete the trial of his murderer after which they would be so confused as to turnout a 4-3 verdict in his favour as not guilty, then something is seriously wrong somewhere. Contrast that with a political trial in which a petition was sent to the highest court of the land in the morning of a particular day and the court came out the afternoon of the same day with a 7-0 verdict in favour of the government. State officials who find themselves churning out these dramas, don't they feel ashamed?
