Should the court tell Bagbin verbatim that his ruling is null and void? My Sory is a lawyer he should tell us which part of the constitution empowers the speaker to make rulings on vacant seats, instead of dancing around the law. If his ruling is unconstitutional, he doesn't have to wait for orders before he corrects his wrong. The ruling means those MPs remain elected unless a court of competent jurisdiction rules that their seats are vacant. Article 97 talks about the case where MPs cross carpets or decide to be independent within the four years they were elected. In this case the four MPs only filed to contest independent on December 7, by which time their current tenure would have expired. The five justices read the constitution in spirit, not in letters unlike the other two. This article could apply if those MPs had stated they will no longer support their parties for the remainder of their tenure in parliament.
