Only after that can the speaker declare the seats vacant. So, which part of the constitution gives the speaker the authority to make the kind of ruling he made? Organs of government enjoys separation of powers as long as they don't transgress their limits set by the constitution. The Supreme Court is not the police, they rule only on cases under their jurisdiction which are brought before them. If the executive does something that you believe is against the constitution its your right to go to the Supreme Court for interpretation.

Brethren all we have to understand is that the Supreme Court is clothed with all the powers and mandate to interprete and resolve all disputes or misunderstanding in the application of the constitution to our governing of our nation. The subject in question is the CONSTITUTION and which l believe parliament has no business in interpreting any of the provisions contained in our constitution!!! To avoid any ambiguity which might emanate from other provisions of the constitution that also has every tendency to conflict with the powers given the Supreme Court in its duty, we all should allow the Supreme Court to basically function as enshrined in the constitution with that duty. The alternative as we see today should only be done by allowing for a Judicial Review if there's any misunderstanding that emanates from the ruling given by the Supreme Court in interpreting the provisions of the constitution.

The supreme court has the sole jurisdiction when it comes to meaning of provisions in the constitution irrespective of the subject matter. In ex parte Zanetor the court applied this principle to determine the question of who is candidate for office of member of parliament
