From a very non political, non-partisan, nationalistic and patriotic view, the Supreme Court's undue interference in the work of Parliament is extremely dangerous. It sets a very dangerous precedence which is likely to be emulated by future governments using the judiciary as pawns and puppets to be manipulated by the puppet master. One more time, let me explain a very simple rule that even a kindergartner will understand. If you use a clause in the constitution to make ANY judgment that affects another Ghanaian or entity, that ruling can be referred to the Supreme Court for proper interpretation. The Supreme Court is the only institution vested with the power to interpret the constitution, not Parliament or even the presidency. Bagbin cannot sit in parliament and use a clause in the constitution to back up his decision and challenge the Supreme Court’s ability to reverse it if needs be. Apparently there are two groups of people in Ghana. One that believes in the law, and the other one that believes in violent buga buga and lawless ways in doing things. Your guess is as good as mine.

What then happens to the SPIRIT OF THE LAW, MORALITY, CONSCIENCE, PRECEDENCE IN PARLIAMENT, PUBLIC PERCEPTION AND OPINION? The judiciary is not a conglomerate of superhumans with extraordinary ability. That's why jurors are picked randomly from all manner of people across the world, including Ghana to even determine cases including death penalties. If we create a frankenstein monster, it will come round to devour us one day. What we must all remember, however is that justice resides in the conscience of the people, not in the bosom of the judiciary.

In 2020, the MP side in Parliament had a commanding majority. The Speaker of Parliament, Prof. Mike Aaron Oquay, was from the NPP side. His seat was declared vacant. And the NPP was happy.
That ruling was the first of its kind.
In 2024, the NPP, with the slimmest majority in Parliament but the Speaker from the opposition NDC, were up in arms when Speaker Alban S.K. Bagbin ruled that some NDC and NPP MPs who intend to contest the 2024 election should vacate their seats. The net effect put the NPP on the minority side in Parliament.
The NPP side went to court, and the Supreme Court ruled that an MP who declares his or her intention to contest the next election as an independent candidate or on the ticket of another party should not be expelled from Parliament. The NPP was happy.
That ruling was the first of its kind.
If you look at this critically, it is the NPP fighting itself, winning, and being happy.

@DotCom, did you listen to yourself? In your logic Supreme Court has determined the majority party in Parliament. Where from this conclusion? Please SC hasn't done anything of that sort. The SC simply said that it's unconstitutional for the Speaker to have removed sitting MPs from Parliament just because they've expressed different mode by which they seek to enter Parliament in the FUTURE. How did this decision come to mean that SC has determined the majority in Parliament? Note carefully, neither the SC nor Speaker of Parliament has power to determine the majority or minority in Parliament. That power lies exclusively in the hands of the electorates at the polling stations on the voting day. It's good to learn and understand issues before you comment on them. Don't spew your ignorance to the publuc as the gospel truth, please.

You see where the NDC has put itself? The MPs cannot eat humble pie and go back to their minority side. Ego is now killing them. They want to sabotage government business which will affect you and me...but they keep blaming the NPP of causing financial loss to the state (a beautiful way they hope to court public sympathy!). Nii Lantey, you will return to parliament in 2025 even fewer than you are now. Ghanaians made a huge mistake by voting for so many immature hooligans like you and your colleagues (except Dr. Ayine, Muntaka and Haruna). The rest of the NDC MPs are immature emotional fools.

The truth of the matter is, the supreme court has lost its credibility by always giving verdict in a specific way.
The best thing in my view, would have been, for the SC to ask Afenyo-Markin to go back to parliament for amicable solution and in that way, throw the matter out of court, order the matter to go to the high court as stipulated in the constitution for fairness but just giving this ruling makes things complicated in the short and long term.
I believe ndc is protecting or if I should say sending a strong indication that in the event of "go to court" scenario or npp running to SC for solace won't be as before. Though!
The outcome of this ruling, makes it obvious that it will impact on the election as npp can easily create a go to court scenario.
Difficult times ahead. I think Bagbin has been fair in his dealings in parliament hitherto, considering 137 on either side.

Take the ruling of the supreme court to the lecturers at the law school and see the mark they will score. Let your common sense guide you. It's not just the rule of law but the rule of sensible law. After Prof. Oquoaye had used the same article to rule against Gyekye Quayson for many months apart from eating and going to toilet, Godfred Dame ,the attorney general has been reading the constitution everyday but he never saw or noted that Oquaye's ruling was unconstitutional. But just less that a week that Alban Bagbin used the same article to rule against NPP he immediately saw the unconstitutionality. And miraculously the supreme court who has been sleeping all these while woke up all of a sudden to rule in support of Dame. Is that the rule of law?. I beg you, ustice must be seen to be done. Even though it's being said that the law doesn't tell the truth always, this is too much...... But wait a minute; how did the supreme court get to know that Afenyo Markin was coming with a complain tthat he received that swift and quick response. WHO CALLED THEM? and it was a friday. Not Ghana first but rather Ghana last.

Even if the supreme court has ruled, the decision will have to be effected in parliament through voting to reverse the speaker earlier ruling. And NDc may stay away from voting. This is an example of the contradictions the Unitary/Centralised State system Ghana is still using as a management model is throwing up - the nation is slowly being crippled by this defunct edifice which is no longer fit for purpose.
We need to boldly build a new state model and take it to Ghanaians in a Referendum to move our nation forward - we are stuck with an old ALbion truck (the state) donated by Queen Elizabeth I which is both expensive and unable to function as a fit system of governance for a nation 10x greater than it's original population - let's say "No thank You" politely to it and move on.
I'm I the only one who can see this crises?
