Don't blame the Supreme Court for the failure of Bagbin and NDC to read the constitution. The constitution says ONLY the high court has the jurisdiction to determine whether seats are vacant or not. Which means the speaker can only enforce but not rule that seats are vacant. No where in our constitution does the speaker has the power to make a ruling that seats have become vacant. Technically, the ruling of Bagbin was UNCONSTITUTIONAL! It doesn't matter if there's a precedence which wasn't brought before the Supreme Court. Anyone could have challenged Mike Oquaye when he declared Fomena vacant, but he got away with it because no one did. So, if the NDC really want to pursue the case they should go to the high court and stop the media hullabaloo. As for the Supreme Court they haven't touched the case itself, but the constitutionality of Bagbin's ruling which is clearly under their jurisdiction.

I have read the constitution and in Section 97 article 1g and1h, it clearly states in very plain language in its simplistic terms about MP when crossing the carpet will have their seats declared vacant. The reason is very simple to make sure that no political party manipulates the system.
Next time the nominees for the supreme court is sent to Parliament, their political affiliation and their interpretation of the constitution should pushed during vetting.

Also, that is not what the Article 97(g,h) was meant for . It was meant to prevent the issue of cross carpeting ( where an MP voted because of party A goes to Parliament and decides he wants to work with party B. It happened in the independence era Parliament where many opposition MPs resigned and joined the CPP while in Parliament . That was a fraud on the ppl who voted for them . Also it weakened the minority and allowed the CPP to go ahead and draft a one party state constitution. In order to avoid that , the drafters of the 1992 constitution put in those clauses to prevent such occurrences. In 2006 and NDC MP Alhassan Wayo Mp for Tamale Central resigned from the NDC and joined the NPP , his seat was declared vacant and a bye election was held . He lost. So that is what those clauses are about .

We should learn to be deep thinking leaders instead talking pretenders. This is elementary logic. There are MPs who have been replaced or have opted out as PC but are representing their constituency until their current term expires. In the next Parliament the election outcome will determine who occupies the seat. Now just like these MPs another set of MP have also lost their candidacy in their political parties but are yet to complete their unexpired term as representatives of their constituency. They have exercised their right to still stand the next elections despite losing to other candidates. This is a matter to be determined in the next elections. Is it too difficult to understand that this is not crossing carpet from one party to another. Supreme Court interpretation of the law are precedent setting not emotional balancing of scores to look good today and cause confusion later. Bravo to the wise.

He first set aside the judiciary and established his kangaroo courts in the country and he called that illegal court “ the People’s Tribunal. After that he killed the three High Court Judges in 1982. And as if that’s not enough, do you also remember how John Bull Mahama’s administration trampled down the Judiciary after the supreme court ruled in favor of his 2012 electoral victory over Akufo-Addo?
Shortly after that the criminal kingpin Mahama called the bluffs on the Supreme Court by allowing his thugs “ those Montie 3 morons to threaten the then Chief Justice Mrs Theodora Woods; that “they would seize her and marry her by force”. Then after the Supreme Court convicted those three morons and sentenced them to serve six months jail time, John Mahama went ahead and released them with executive orders. He pardoned them against the advice of almost all stake holders, especially the BAR association. the Ghana Legal Council among many others.
Even at the time most of the Justices at the Supreme Court were his appointees he refused to give them the due respect, when will the NDC allow the Judiciary to undertake their duties without fear of favor or interference?

The Supreme Court literally just attacked and rubbished the constitution with its decision. Now the framers of the 4th republic constitution wanted to prevent that happening again . So the clauses were put in to prevent that from happening again because if that happens Parliament becomes unstable . And the MPs who switch ranks commit fraud on the ppl who elected them . If they elect you as an MP for party A, then u can’t leave the party to join another party while in Parliament. That is cross carpeting and that is the mischief those clauses were put in to prevent . This time it has not happened . These MPs are still working for their various sides . By signalling their intent to seek the mandate of the ppl on a different ticket they can’t be said to have cross carpeted.
