Sometimes common sense is not common. If an MP resigns from their party to join another, they can still stay in parliament to work against the party that brought them to parliament. Cross-carpeting has now been legalized.

It will have been a breaking news if SC rules in favour of the Speaker.
So when does Article 97 1h applies?
It is effective when following the action of an existing MP, a bye election can be held to fill the seat vacated by the MP. Otherwise that MP has to serve the period remaining to complete the 4 year term.
To every action there's consequence. There's no place for convenience in law. What if the MP died in this period a bye-election can't be held? You guys are just funny.
