Even if there is a constitutional angle, the Supreme Court should deal with that constitutional aspect quickly than to say the police should stand down the arrest.
The legality at this stage is to go to the High Court.

Secondly, Tsatsu neglects the fact that Bagbin cited Article 97, which falls exclusively in the Supreme Court's mandate, to support his decision. I don't know why lawyers are being so dishonest. The Supreme Court never said in their ruling that they have jurisdiction over declaration of vacant seats. What they they did was to give interpretation whether the speaker's ruling based on article 97 was constitutional or not which falls under their jurisdiction. Objective Ghanaians should know that there's no way Tsatsu will acknowledge that the Supreme Court did the right thing because it goes against the NDC. The same way he defended them in their election petition knowing well they lost the elections. That's part of the training of lawyers to know their clients committed a crime yet try to defend them in court and the media knowing deep down their hearts what the truth is. But, that shouldn't get to the level of trying to pull down the judiciary. It won't help anyone going forward even if the NDC comes to power in future. The NPP equally has the numbers to repeat this which to me is not the right thing to do. If the NDC wanted to respect the law, they would have gone to the high court to determine the case after the SupremeCourt directive. There's no short cut to justice. Untill that is done, you can't prejudicially set aside the orders of the Supreme Court and declare yourself majority. It could be possible that the high court declare those seats vacant but you don't say because you believe you're right you take the law into your own hands and became a court of your own. There has never been a case where a person who loses a case at the Supreme Court agrees with their ruling but it's always the case that the Supreme Court ruling is a law on itself and you must abide by the ruling unless steps are taken to reverse it.

Secondly, (and this is interesting), Mr. Tsikata's take on the case before the SC is about 'matters concerning parliamentary seat vacancies' which in his opinion 'lies solely with the High Court. Thus, he says the matter should have been referred to the High Court, (in line with previous decisions by the Supreme Court).
However, the SC had a different take on the case before it. To the Justices (and to some lawyers also), the case was about interpretation of the constitution, a responsibility which lies with the Supreme Court.
So the question perhaps to ask is, What was the case about?
Was it about vacant seats or constitutional interpretation?
