When Haruna Iddrisu pushed for the motion to a. Uproar of opposition he should have counselled him to seek interpretation from the supreme Court to ensure the motion is air-tight for adoption. Lets not get partisan about this issue, look objectively. In the case of Speaker Mike Oquaye declaring the Fomena seat vacant was a party issue, the party the Fomena M.P caucused with push through the motion. Kindly keep your emotions in check because B.P is killing to many young people

Why do you think the speaker erred? I don’t see any error here. Those individuals don’t belong to any of the parliamentary blocks, therefore the majority block that emerges after their departure becomes the majority in parliament.

Either way, u may choose to disagree with me, and that's exactly why Afenyo Markin has gone to the SC to seek an interpretation of Article 97(1)(g) especially. Until the final determination of the matter, the people they represent must not suffer, especially when the MPs have not communicated their intention to leave the majority caucus in which they currently are.

In fact to make such a declaration is to serve notice that you do belong to your current caucus anymore and are by default expunged from the house roll. It's not rocket science. Tell your landlord 2 months before your tenancy expires that you will not be renewing because the property does not meet your needs and yet instruct him to permit your occupancy TILL you find appropriate accomodations whenever convenient for you and your household.

The speaker has NOT VIOLATED the provisions of the constitution as it regards the execution of PARLIAMENTARY PROCEDURE or house rules.

And after that he gave two days to think about it before delivering his ruling…none of the affected MPs was able to deny the evidence that they have filled as independent…You think The speaker sat in his bedroom to pass his ruling? Nobody can overturn the speaker’s ruling, the tables have turned and article 122 is clear…nobody can dictate what should happen in the chamber of parliament so long as what goes on there is constitutional…and this is constitutional based on Article 97…The NPP should allow the constitution and democratic principles to work…

The constitution of Ghana is the supreme law of the land and all legalities are governed by it.The simple question we should ask ourselves is ... who's responsible is it to determine a parliamentary seat vacant? Well, according to the Article 99 (1) (a), states that only the Supreme Court shall have the jurisdiction to hear or determine any question whether a person has validly been elected as an MP or whether the seat of an MP has become vacant. According to this constitutional provision, the Supreme Court doesn't share this jurisdiction with any other body or institution, and certainly, not with the Speaker of parliament.

Was it not this same NDC caucus who went to court to challenge the removal of one of their MPs on account of his dual citizenship? Did they know of any provision of the law giving the Supreme Court jurisdiction then?

Facts :
i)The Applicant asked for an order of the court that will last for 10days. That is the nature of ex parte applications. The law is that after 10days, the applicant must repeat the application on notice so that the Respondent (i.e. the Speaker) can be heard and if a case is made by the Applicant, a lasting order will be made pending the final determination of the suit. The Supreme Court without hearing the Speaker has given an order that will last for the lifetime of the case. Speaker’s right to be heard has been breached.

ii)The Speaker was not in court….So long as he has not been served with the order, he can say he does not know of any such issue.

iii)If care is not taken, Parliament and other institutions (eg EC) will never be able to work. After the elections for instance, if I see that I am losing, I will quickly go the Supreme Court, file an injunction to prevent the declaration of the results. Or if the results have been declared, go for an ex parte stay of execution against the Chief Justice from swearing in an elected President. If Parliament is to discuss a transaction, I can stop them.

The Supreme Court's ruling on the issue sets bad a precedent for the future of rule of law.

In my opinion the Law itself is a common sense. And the Judges are to apply common sense with Law . Is it not assumptions apply to Law? For instance, if I told someone else I will kill you and I have not done it, the question is can the Law hold me? We have a saying actions speak more than words. The judges should apply common sense with Law.

per our constitution it is only parliament that is mandated to make laws.
if it is rightly so ,
if parliament make a bill- that went through all the mandatory process to become a law,
why should the parliament who made the law goes to supreme court for interpretation ?
are we not turning it in the opposite way ?
cardinally is the supreme court that must seek more understanding of the law from parliament house of Ghana because it was parliament who made that law and parliament knows why certain clauses were made in the provisions of that law.
for me i dont understand why parliament who made those laws , must go to supreme court and still ask them understanding of laws that were made by them ? for me it does not make sense.
supreme court may have a duty to do some interpretations of the law for individuals in the country, the executives and some government institutions but not legislative that made those laws.
supreme court must not be allowed to interpret the laws for the legislative.

Leave ndc to fight for power in parliament whilst npp lobby for power on the grounds where the voters are & would want to be educated more on the various policies Bawumia has planned. When npp wins,,you will see Mahama and gen mosquito blaming Jean Mensah again saying she has rigged in all constituencies for npp. Right now ndc plan to cause mayhem in parliament on Tuesday is in almost every citizens WhatsApp inbox by now ,so Ghanaians can see that all they want is to create confusion,fight,& disgrace Ghanaians in parliament to the world like they did in 2020,when some people are supposed to be called dishonorable instead of Honourable
