Well, according to the Article 99 (1) (a), states that only the Supreme Court shall have the jurisdiction to hear or determine any question whether a person has validly been elected as an MP or whether the seat of an MP has become vacant. According to this constitutional provision, the Supreme Court doesn't share this jurisdiction with any other body or institution, and certainly, not with the Speaker of parliament.

i)The Applicant asked for an order of the court that will last for 10days. That is the nature of ex parte applications. The law is that after 10days, the applicant must repeat the application on notice so that the Respondent (i.e. the Speaker) can be heard and if a case is made by the Applicant, a lasting order will be made pending the final determination of the suit. The Supreme Court without hearing the Speaker has given an order that will last for the lifetime of the case. Speaker’s right to be heard has been breached.
ii)The Speaker was not in court….So long as he has not been served with the order, he can say he does not know of any such issue.
iii)If care is not taken, Parliament and other institutions (eg EC) will never be able to work. After the elections for instance, if I see that I am losing, I will quickly go the Supreme Court, file an injunction to prevent the declaration of the results. Or if the results have been declared, go for an ex parte stay of execution against the Chief Justice from swearing in an elected President. If Parliament is to discuss a transaction, I can stop them.
The Supreme Court's ruling on the issue sets bad a precedent for the future of rule of law.

In my opinion the Law itself is a common sense. And the Judges are to apply common sense with Law . Is it not assumptions apply to Law? For instance, if I told someone else I will kill you and I have not done it, the question is can the Law hold me? We have a saying actions speak more than words. cardinally is the supreme court that must seek more understanding of the law from parliament house of Ghana because it was parliament who made that law and parliament knows why certain clauses were made in the provisions of that law.

supreme court may have a duty to do some interpretations of the law for individuals in the country, the executives and some government institutions but not legislative that made those laws.
