The speaker was not joined in the application to the court, and as such didn’t have to be called by the court. The issue is purely a constitutional one, and the only body responsible for interpreting the constitution is the Supreme Court, not parliament. As a former Director of the Ghana School of Law, he should not be giving this wrong opinion.

No they did not but instead directing parliament in this case to stay any decision until the matter is properly heard and determination made upon. The speaker clearly inform all Ghanaians that he was not interpreting the laws but rather only enforcing same by his understanding. So if he is wrong, the court should say so and review what he the speaker did. That way it becomes law and guide going forward. The supreme Court can not be directing what parliament should be doing administratively.

The supreme Court globally have the mandate to interpret any laws passed by the land and if found contradictions which at times comes from the human right law, they can re-write the law either shredding it by taking certain things out or adding more to it even though its not their mandate to make new law. It is their mandate to interpret the law passed and correct errors. If deemed to have contradictions they can amend the law passed and sometimes it doesn't happen until someone challenges or seek interpretation in the court so what they have done is done everywhere globally. America is a typical example with so many cases where the supreme Court has overruled parliament on some issues so you can do your research if wants to learn and don't follow these bias politicians and the so called lawyers who are supporters of either party A or B and wants to politicise everything.

The speaker then have no right to declare those seat as vacant to deny peoples legitimate votes especially when there cannot be by-election to for those seats to be represented. Those individuals should remain as the legitimate elected candidates until elections are conducted and those people are given the right to choose another representatives. Until then not even supreme Court can deny those people representatives and likewise not the speaker of parliament.

My question is, is the speaker a real lawyer, I doubt because this is so easy for him to understand without such unpardonable error. They are using the decision taken by Mike Ocquaye but the two cases are not the same.

Emperor Bagbin,the omnipotent one did not even follow the wrong precedent by Prof Ocquaye he cited,it was then Majority Leader who reported a member of his caucus to the Speaker that he has filed for election as independent candidate,is Ato Forson Leader of the NPP caucus to report NPP members to Speaker on the matter? Incompetence even in opposition,if they are not careful NDC will end up with 135 while NPP maintain their 136.NDC in their haste to cause mischief and confusion in concert with their disgraced Speaker have shot them selves in the foot.

Akuffo Addo's tenure has been the most lawless and reckless one. What saddens me most is that, he thinks he has hoodwinked all of us but the truth is that, when he was going about parroting his rule of law mantra, I never for once believed him.

I can't wait for him to disappear into oblivion with his fake laughter after the elections. Good riddance to a useless 8 year reign of lawlessness.
