How's it that a declaration of an intent and filling of nomination is not a severance of an alliance? There's no law that holds anyone captive to any political party and so the only lawful proof of severance of alliance is when the person stands as an independent candidate or defects and stands on the ticket of the new party.
Additionally, if your assertion is to hold, elections have to be held in a constituency whenever someone defects or goes independent. Since that is not the case, we can safely conclude that at the time you file on the ticket of a different political party or go independent, your status changes. In any case, how can one file on a ticket of NDC for an election in December and hold him/herself today as NPP parliamentarian? Isn't that a conflict of interest? The honorable thing would have been to resign the position earlier for by-elections to be held. Oops, too late.
Lastly, per your logic, this law only applies after the elections. I think what you're actually saying is that the law is a bad one. Otherwise, how will this law be relevant after the elections when the person has now been elected or otherwise on his/her new ticket?
I hate to burst you bubble but NDC has a case and there's no way around it unless, NPP decides to circumvent the law.
