He couldn't proof his case beyond reasonable doubt on all charges against the journalist. After all this is a peanut. Many judges would have imposed hefty fines and damages for lying about someone, causing his arrest and detention by police, losing his job in the process, wasting time and money to and from court appearances plus legal fees, etc.
