The Supreme Court on May 28, 2026, rejected a letter from former Attorney General Godfred Yeboah Dame notifying the court of his decision to withdraw his legal services from former Chief Justice Gertrude Araba Esaaba Sackey Torkornoo.

The Supreme Court, in its ruling, described the notice as “defective” and stated that it did not meet the required legal standards.

During the proceedings, a seven-member panel chaired by Justice Amadu Tanko noted that there was no evidence before the court showing that Justice Torkornoo had been served with the notice of withdrawal filed by her lawyers.

The court further stated that it must be satisfied that the former Chief Justice had been properly notified about Dame’s decision to withdraw from the case.

However, the court treated Godfred Dame’s initial filings and processes as still valid and adopted them as part of the record for the determination of the case.

This means the court will proceed to judgment with the filings already on record while allowing Justice Torkornoo to respond after being formally served.

Meanwhile, the case has been adjourned to July 2, 2026, for judgment in four separate actions challenging the processes leading to the removal of the former Chief Justice.

Background

The case stems from a series of constitutional challenges before the court concerning the handling of petitions and procedures linked to the removal of the former Chief Justice from office.

As part of the proceedings, Godfred Dame had earlier written to the Supreme Court indicating that he was withdrawing his legal services in the matter involving Justice Torkornoo.

In 2025, Dame faced criticism for representing the then-suspended Chief Justice in a legal matter, even as she was already facing petitions that eventually led to her suspension.

At the time, concerns were raised about a potential conflict of interest arising from his prior role as Attorney General.

However, Dame rejected the allegations and maintained that his actions were lawful and proper.
