Lawyer and Convention People's Party (CPP) member, Kwame Jantuah, has called for a review of the process by which judges are nominated to the country’s superior courts.
According to him, that mandate should be taken away from the Executive and given exclusively to the Judiciary, to ensure a strict separation of powers and prevent political interference.

Speaking on Asaase Radio on September 27, 2025, Jantuah stated that his proposal would help eliminate the perception of judges being politically biased simply because they are nominated by the Executive.
“Look, for me, that mandate we’ve given the president to nominate [judges] in the constitution should be cancelled. That is what is creating all this, and it should be cancelled. If we say strict separation of powers, the Executive should have nothing to do with putting judges in place; absolutely nothing.
“It is not the judge who puts the president in place. It's the people of Ghana, and we have the right to do it [because] the constitution mandates us to do it. So, why is it that when it comes to judges, it should be the Executive who puts a judge in place? This is what is creating all this mess,” he lamented.
Jantuah further stated that this constitutional provision should be one of the key issues addressed by the Constitutional Review Commission.
He also suggested that judges who wish to serve on the Supreme Court Bench should be required to apply, provided they meet the necessary qualifications, and be nominated by the Judiciary.
“I hope the constitutional review committee has looked at these particular things and has rectified them in the constitution,” he said.

He added, “Let their own [Judiciary] nominate. Let those who want to be Supreme Court judges apply and let the people of Ghana know that those who have applied have the capacity to achieve justice.”
