The High Court has directed Nana Appiah Mensah, popularly known as NAM1, the Chief Executive of the defunct Menzgold Company Limited to file his witness statement after he attempted to give oral testimony.

According to a report by 3news.com, this follows the Supreme Court’s dismissal of his application to quash the High Court’s earlier decision.

During court proceedings on Monday, February 2, 2026, NAM1’s counsel, Emmanuel Amoakohene, requested the court to strike out an application to stay proceedings, noting that their judicial review application at the Supreme Court had been withdrawn.

“We scheduled a motion to stay proceedings before you today. That application has, however, been rendered nugatory following the decision of the applicant to withdraw the substantive application before the Supreme Court. We seek your leave to have our pending application struck out as withdrawn,” he told the court.

The prosecution, led by Senior State Attorney Watkins Adama, did not oppose the request, and the court granted it. Amoakohene, however, noted that their appeal against the High Court’s decision at the Court of Appeal was still pending.

During his testimony, NAM1 told the court that Menzgold had legitimately obtained operational licences from the Precious Mineral Marketing Company (PMMC) after undergoing extensive scrutiny.

“The company applied to PMMC, completed all relevant documentation, and paid the necessary fees. We were subjected to PMMC’s internal processes and screening and were issued a licence to undertake our operations,” he explained.

He added that after PMMC’s status changed to a national assay office, Menzgold was advised to apply to the Minerals Commission.

The application went through all required processes, including submission of a detailed business profile, payment of fees, and signing of necessary documents, after which the company obtained approval to operate.

When asked to produce proof of the licences, NAM1 said he would present them at the next adjourned date.

He also indicated that following the shutdown of Menzgold and Brew Marketing Consult by the Securities and Exchange Commission (SEC), the Economic and Organised Crime Office (EOCO) took control of the offices, affecting the availability of documents that could support his defence.

Presiding Judge Sedinam Kwadam has ordered NAM1 to file his witness statement, attaching all relevant documentary evidence, by February 9, 2026.
