King Faisal Dragged to Court

Ashanti Heroes football club chairman, Mr. Frank Effah, has filed a writ in court against Alhaji Grunsah (pictured) and his King Faisal Football Club for breaching a contract entered into in April 1999 in respect of Frank Osei, a football player currently playing for Kumasi Asante Kotoko.

By the said writ filed on May 21, this year the plaintiff, Effah, is seeking specific performance of the agreement. He stated that Grunsah's refusal to comply with the terms in spite of repeated demands, is a clear breach of contract for which a total of ?510 million is being demanded.

The Ashanti Heroes chairman is claiming ?50 million for expenditure on the transfer; ?400 million on loss of potential earnings and loss of 30% of transfer fee of ?200 million for Frank Osei.

The plaintiff wants the court to compel the defendants to comply with the terms of the said contract when it gives out judgment next Thursday. He said unless Grunsah is compelled by court to honour the terms of the agreement, he would not honour it.

Effah's statement of claim was that Ashanti Heroes agreed to transfer Frank Osei to King Faisal on April 7, 1999 on the request of Alhaji Grunsah. Under the agreement, King Faisal was entitled to 70% of the transfer fee, should it transfer the player to another club while the plaintiff's team (Ashanti Heroes) took 30%.
The plaintiff claims the defendants have transferred Frank Osei, described as a player of great promise and talent capable of getting a lucrative foreign contract, to Kumasi Asante Kotoko for ?200 million but has refused to pay the 30% transfer fee as agreed upon.
Following a formal complaint to the Ghana Football Association, Alhaji Grunsah was directed to honour the terms of contract but has since March 14, this year, not only refused to comply with the GFA directive but also ignored it.
Grunsah has also ignored a letter by the plaintiff's solicitors demanding his share of the transfer fee of the player.
By the defendant's default, the plaintiff claims, he stands the risk of losing revenue which could otherwise accrue to it by reason of such transfer.
Grunsah has not filed any defence yet to chairman Effah's claims.
