First defamation is not proved by the standard of 'proof beyond reasonable doubt' Second the fact that the Prez has many 'Ibrahim' brothers does not mean that the plaintiff in this matter cannot sue on defamation. In defamation the liability is based on 'not who is targeted but who is hit'. Seek legal advice and you may understand.

President Mahama has only one brother called Ibrahim. And the President's only brother who has bought a plane is Ibrhim. So Mr Pink-Sheet, please come again.
It is clear Wontumi defamed Ibrahim.

Mr Yawose, I am also not a lawyer but I am not totally naive in some matters of law. I am afraid your uncle might have miseducated you on this case.
Let us even assume that your uncle is right that President Mahama has many brothers all called Ibrahim. There is a Ghanaian proverb that "one does not need to point the skies to a child to show the child where God is" (I hope I have got the translation right). It is no secret in Ghana the Ibrahim brother of President Mahama is the one who is the majority shareholder of a company that obtained a loan from Merchant Bank which ran into some difficulties. There is no secret in Ghana that that Ibrahim is alleged to own a plane, has business interest in South Africa and often travels there. There is no secret in Ghana that it was this same brother Ibrahim that then Vice-President Mahama intervened on his behalf regarding his business loan with Merchant Bank, etc, etc. Finally, there is no secret in Ghana that when Wontumi made those allegations most Ghanaians of age and sound mind knew who he was referring to. For these facts, your uncle would be mistaken to believe that the case would be dismissed as frivolous. This is not comparable to the example of ET Mensah you mentioned.
The law is on the side of Ibrahim, especially when he is not a politician and does not hold any public appointment in President Mahama's government. Even if he held a public appointment in the government, he would still have the right like every Ghanaian not to be defamed by wild allegations.
Wontumi has a case to answer for his irresponsible behaviour. I hope he is not another Sir John.

Your uncle is the epitome of what is all wrong with this country, our politics and our thinking. I am not a lawyer but his argument lacks logic and plain common sense. It just encourages sedition, libel and slander.

If 77 parcels of cocaine did not arrive in Ghana and vanished into thin air the NPP should have sued Kofi Adam long ago. If Nana Addo did not wake up in the morning with a cloud of wee hanging on his face and speaks profane even at the funeral of his former girl friend he should have sued Owura Mangotey long long time ago. See how guilt make NPP mumumu! He that steals to lick flour cannot speak when caught on the act.

It has to be proved beyond reasonable doubt that the defamation is in effect; that this dis-graceful statement did refer to the party who demanded an apology; that the defence has no such previous record; and that the defence actually produced those dirty statements. For all you know Wontumi has evidence to support his allegations against Ibrahim of E&P so the question of which Ibrahim becomes a non-starter. Secondy, if all of Mahama's brothers are called Ibrahim, do they all own planes? And thirdly, are you seriously suggesting that Wontumi will consider hiding behind your argument in court, if he is man enough to spew defamatory statements then he should be man enough to defend himself in court.

I would also love to hear a judge throw out the case on some flimsy excuse to endorse the corrupt institution of the judiciary. In either case it would offer a window into gutter politics and the people who man the institutions for all to see.

Mr Yawose, even from my lay man's perspective, this is a Matter of Law. Wontumi is not facing a legal threat for simply making insinuations or merely criticising John Mahama led-NDC Government here. Wontumi made serious allegations against Ibrahim Mahama, the CEO of E&P, who happens to be the brother of President John Mahama as a conduit and beneficiary of corruption. Ibrahim Mahama has the right to protect his personal reputation and his business integrity.
Ibrahim Mahama is pursuing legal action against Wontumi for his defamatory allegations. In such case, Ibrahim Mahama's lawyers must prove to the court he's President Mahama's brother. Ibrahim's lawyers must prove that Wontumi's allegations are false to succeed in their claim. This forms the basis of a defamation claim.
What is Wontumi's defence? In his defence, he's going to claim he made those allegations against Ibrahim and John Mahama as a matter of 'public interest' which isn't straightforward or relevant to Ibrahim, particularly. Did Wontumi make 'factually correct' statements in making those allegations against Ibrahim? Wontumi must present evidence that Ibrahim is a conduit of corruption and beneficiary of improper conduct of his brother John Mahama.
As Ghanaians, we should not tolerate totally unjustified and inappropriate allegations against certain high profile individuals and politicians all in the name of our partisan politics.
