He also implies the outcomes of the court ruling will make future contracts extremely costly for the government since foreign companies would essentially protect their interests with international contract laws if they must agree to work in Ghana. I think it makes sense.

There have been about 3 or 4 cases already. The latest involves a Ghanaian-American and his US partners suing both the GOG and AMA - not for any work done - but for a certain contract not being awarded to them!

They involve several processes which culminates in the signing on the dotted lines by the authorized parties. In Ghana the Minister signs on behalf of the people of Ghana. Parliament is the representative of the people of Ghana who are the ultimate beneficiaries of the fruites of the CONTRACTs. Parliamentary approval is to secure check and balance to expose irresponsible professionals like the Deputy AG and their ilk who eager to sign away Ghana's assets. Two heads are better than one so the saying goes. Any serious foreign investor will engage the services of competent lawer to do due diligence of Ghana's legal regime before entering into contracts. In Finland it is the duty of parties to ensure that every material that has a bearing on the execution of contract is taking care of during negotiations and execution. Ignorance is not a defense.

The Court ruled in favor of the government solely because of Article 181(5) and not because of the merits of the case. And so for clowns like Ken Agyapong to play Christ, willing to raise Mills from the dead, is to show he could not have learnt much from his Adisadel days.
The one thing about contracts Ken Agyapong, Kweku Baako, J.J. Rawlings, Martin Amidu and others pretend it did not happen is the fact that a Ghana government representative approved for Waterville to move their heavy machinery to the Accra Sports stadium to start work. A contract has been initiated or effected when a party representative agrees for work to commence even if the paper contract has not been signed. It is common sense and contract law. Unfortunately most in Ghana either lack this fundamental wisdom or too ignorant to read.

I really can't get what the rigmarole abt the SC decision is about. That it is a bad thing for Ghana to follow const'nal provisions in awarding foreign contracts? Or, those already awarded without following the const'nal provision by getting Parliamentary approval are at risk 'cos the rogues, "greedy bastards," charlatans, "thieves and thiefettes" that man or govt machinery and probably signed those contracts might go to court to renounce them so that govt doesn't pay for already executed contracts; or those wrongly abrogated??? So what is the argument about?
What is so difficult for govt to follow the simple procedure of putting negotiated contracts before Parliament to be perused and approved? Oh! That might open up such contracts to queries about amounts padded on them to be paid as bribes, for every bribe paid by foreigners to crooked politicians and bureaucrats are actually paid for by the Ghanaian tax payers! Ordinary Ghanaians should rather be celebrating abt the SC decision, not being hoodwinked that it is a dangerous decision. Foreign investors are not stupid. They simply have to insist on and wait for the Parliamentary approval before starting the execution of any project. Any delay doesn't cost them anything. It costs Ghana.
As for those contracts not properly signed and approved, the law on causing Financial Loss to the State was originally signed to deal with such malignant state officials causing us losses through their negligence or collusion with corrupt elements, local or foreign. Apply the law to them!
Ankomah was in Parliament for many years on the majority side. Can he tell us why the necessary Parliamentary Act wasn't passed to fulfill the const'nal proviso? Enough of the chicanery.
The only sensible thing I read from this piece is the emphasis that it was NOT about Woyome but Waterville, which indeed is the mafioso organisation behind their Capo Woyome. The stupendous focusing on Woyome by the NPP adherents is simply a deflection of attention from the real villain, Waterville!
