I will tell you why you don't understand nothing that's going on. 1) going to court is about allegations and evidence to support that allegation. so if a petitioner alleges something he must back it up with proof( evidence) and that evidence is goin to be examined in court. the examination of the evidence can constitute an examination of the way the evidence was obtained, analysed, collated, submitted etc. so it is totally normal for any lawyer to attack the credibility of the evidence without speaking directly to the contents of the evidence. evidence could be good but if in its preparation etc it has been compromised then that evidence can be thrown out of court; The simplest case I can use to explain this to you is that in the US a police investigator or officer can come upon a suspect murdering another person but if he commits the arrest without reading the suspect their "Miranda" rights then the case gets thrown our because the procedure used to arrest and investigate the suspect is incorrect, this does not make the evidence untrue or whatever. this is the technicality of the law you don't understand.
2) wy should he accept Bawumias explanation about the duplicated pink sheets? did u even understand why he kept on reading out the details of the various pink sheets? he is attacking the credibility of the evidence and he is allowed to do so, the writer shows his bias and lack of understanding when he asks why the justices are allowing this to continue? this is because the lawyer is leading evidence to suggest duplication of polling stations, errors and fraud on the part of the petitioners and he is totally allowed to do so if he has proof of it.
3) don't hold your breath about the no verification no vote annulments. yesterday when Bawumia was told by his own councel about the response of the EC to this allegation ( a quote of the constitution no less) he simply said what he understood was that there would be no voting without verification. a meek and sorry answer when confronted with the law.

Mr Awah, I told my readers from the beginning that I am not a lawyer but I have watched enough court cases including the confirmation of Justice Thomas to the USA Supreme court and O.J Simpson murder trial to understand what Lawyer Lithur was trying to do and I even mentioned it in my article that he was trying to impeach Dr. Bawumiah's evidence. Did you read the article?
My problem with his line of questioning is that, after asking the witness to explain ten of these same questions and having proved his point, he could have moved on by telling the court he has about 1000 of such sheets and sought the permission of the court to tender them in as exhibits.
So Mister, if lawyer Lithur has 1000 of such sheets, is he going to introduce each one into evidence like he is doing? No court will allow such an abuse to go on and even one of the Judges asked him if what he was doing was necessary after doing this for a while and he was allowed to continue on that line.
I am not a Lawyer but believe me, at a point in time, if he continue on the same line of questioning, the court will ask him to move on and abandon this line of questioning haven proven his point.

My two cents to those ndc sympathizers who are jubilating because over how bawumia organized his evidence by presenting multiple copies of pink sheets to support each of the categories of fraud. bawumia categorized his allegations into four and for each one of them, he provided copies of pink sheets that were affected to support his claims. these were mere copies that he emphasized were not included in the final calculations. don't you think the ndc lawyers need to have a better approach to disputing the figures than quarreling over why he organized his claims into four with each having copies of the pink sheets that supported them? picture your office with various files, files on different subject matter and with contents that may be found in more than one file because you deal with them under different issues. i do that to make referencing easier for me. i see nothing wrong with that in so far as they were not included in his calculations. in any case, it is the court that will be doing the final tally so why don't you wait for their final say? after all they even asked the ndc judge to move on since they were being repetitive. do you think they will ask him to move on if he were making sense?

But that was not what he admitted to yesterday; Bawumia admitted that the same pink sheet for the same polling station had been filed into evidence at the court under two different evidence numbers and under two seperate categories of fraud, this was after he claimed that no pink sheet was duplicated and thus each polling station pink sheet was used only once for a single category of alleged fraud. Tony lithur was able to show the court that this was incorrect, not only had the petitioners submitted into evidence multiple copies of the same polling station pink sheets but they also submitted the same pink sheets with multiple exhibit numbers under multiple fraud allegations, Bawumia claimed it was an error, but it does not deny the fact that the petitioners submitted multiple pink sheets of the same polling station with multiple exhibit numbers under multiple fraud allegations. their excuse that it was digital versus manual does not negate the fact that the sheets were submitted as evidence in court wether they were used individually in his analysis or not. Tony lithur will continue to attack the credibility of the collection and presentation of the evidence as he is allowed to in court.

My friend, stop this nonsense, you are getting out of hand. Bawuniah never admitted any kind of fraud. Some of us watched it live and you cannot come here and say things that was never said.
Bawumiah said that, the mistake was due to the fact that they have to submit a large volume of documents and they were copying them manually but due to time constraints, they switched to computer which generated different numbers as compared to the manual pink sheets. He said that, though it looks like double counting but on the CDROM which he wanted to use as the analysis of the final tally, no polling station was counted twice. Please, keep your dignity and don't embelish what was not said.

Bawumia confirmed that they had indeed submitted as affidavit evidence two copies of the same polling sheet for the same polling station with different exhibit numbers under different allegation of electoral fraud and that is a fact.
Lawyer Lithur after reading out the details of the two copies of the pink sheet passed them to Bawumia with the following statement. "can you tell the court wether these are the same pink sheets for the same polling station with two separate exhibit numbers filed under two separate allegations of fraud" and for every pair Bawumia answered yes that they were the same pink sheet, same polling station, separate exhibit numbers referencing separate allegations of fraud.
Lawyer Lithur was challenging Bawumia's assertion that he had not at anytime double counted the pink sheets - meaning that at no time had he taken one pink sheet and counted it everytime he found evidence of a class of alleged fraud on it. that is double counting. that was what Lithur was challenging by showing that indeed they had submitted affidavit evidence to the court that showed that they had counted various sheets twice - same sheet, same polling station, different exhibit numbers indicating different classes of fraud.
Why did Bawumia keep on insisting that his analysis on the CDrom showed otherwise ie he had only picked each polling station once???? why did Lawyer Akuffo have to explain their mistakes, their lack of personnel and limited time???????

A legal practitioner, Samson Lardy Ayenini has expressed surprise at the decision by judges at the Supreme Court to overrule an objection by respondents in the election petition on fresh documents tended in by the petitioners.
Dr Mahamudu Bawumia, a petitioner in the case, before he was cross examined admitted to referring to documents which tabled all the polling stations that the petitioners have deleted from their claims of over voting.
Lead counsel for the third respondent, Tsatsu Tsikata had baited the witness to tender those documents, and immediately that was done he raised an objection and asked the court not to allow that. This was supported by counsel for the other respondents.
According to the lead counsel for the first respondent, Mr Tony Lithur, the witness cannot amend his claims in the witness box.
But lead counsel for the petitioners, Philip Addison explained that the petitioners were not “amending,” but “what we are seeing to do is to abandon part of the evidence.”
So controversial was this point that the judges had to take a break to consider a ruling. And just like yesterday, the respondents again lost as the judges overruled their objection.
President of the panel, Justice Atuguba explained that the respondents’ “objection is belated; it is therefore accordingly overruled".
But in his analysis of the ruling, lawyer Samson Lardy Ayenini told Joy FM’s Top Story on Thursday he was shocked by the decision.
“I was surprised at the outcome that they were overruled,” he stated.
Though he admitted, like many, he was learning a lot from the hearing, he suggested that the claim that the objection was belated leaves a lot to be desired.
He explained that since the petitioners had not tended in the document, legally, the respondents cannot object to the document. He said this informed the lead counsel for the NDC Tsatsu Tsikata to bait the key witness to tender the document to pave way for the objection.
Mr Samson Ayenini said had the court upheld the objection, the petitioners would have gone back to amend their petition to “cure the challenge that the update documents pose to them”.

Sarp, Tony Lithur's cross examination of Bawumia was embarrassing, and tested the patience of the Justices. You don't spend four hours on cross on 38 pieces of pink sheets that has insignificant bearing on the Petitioners' analysis of the case. It was poor attempt to impeach the witness and it backfired badly. Bawumia knew what Lithur was up to and he derailed with his first two answers. Lithur should have stopped and moved on to other areas of inquiry. But it appears he didn't have an alternate plan so kept on with the line of inquiry adnorseum. A good trial lawyer will not try to "bury" a witness especially if the witness has not been deposed and does not know what answer the witness will give to a question. Additionally, Lithur fails to realize that Bawumia is well vexed in statistical analysis so Lithur can never out smart Bawumia on that subject. Bawumia is too smart and Lithur should not try to play a statistician in the courtroom .

1) tony lithur's line of questioning emanated from Bawumia's own assertion that the evidence was free of double counting and he had at no time counted a pink sheet twice in his compilation of the evidence, in short a pink sheet was counted only once for a category of fraud and not used for another to avoid double counting.
2) following Bawumia's assertion, Tony Lithur went ahead to show using the petitioners own evidence tendered in at the supreme court (not radio babble, not newspaper propaganda but the petitioners own afidavits filed at the supreme court signed by Bawumia himself)that indeed the petitioners had tendered to the courts as evidence the same pink sheet for one single polling station twice with two different evidence numbers under two separate categories of fraud.
3) Bawumia indeed confirmed Lithurs' assertions that they had submitted two copies of the same pink sheet of the same polling station with two different exhibit numbers under two separate categories of fraud.
4) Bawumia's comment that it was simply a manual versus digital referencing problem that had created this issue is not sufficient to annul the fact that the petitioners indeed submitted the same pink sheet for the same polling station twice with two separate exhibit numbers under separate categories of alleged fraud. his explanation that is was not so on the cdrom does not vindicate him because the petitioners have as fact tendered double counted sheets as evidence. Both Bawumia and Lawyer Akuffo confirmed this when they said they had made mistakes in submitting the evidence.
5) in any court case the credibility of evidence can be attacked not only for its truthfulness but also how it was gathered and how it was handled and interpreted to fit the case. so in simple terms DNA evidence can show that suspect a murdered victim b, but if in the collection, handling and interpretation of this DNA, wrong procedures were followed etc, the evidence will be thrown out irrespective of its truthfulness or not.

Mr Awah, I told my readers from the beginning that I am not a lawyer but I have watched enough court cases including the confirmation of Justice Thomas to the USA Supreme court and O.J Simpson murder trial to understand what Lawyer Lithur was trying to do and I even mentioned it in my article that he was trying to impeach Dr. Bawumiah's evidence. Did you read the article?
My problem with his line of questioning is that, after asking the witness to explain ten of these same questions and having proved his point, he could have moved on by telling the court he has about 1000 of such sheets and sought the permission of the court to tender them in as exhibits.
So Mister, if lawyer Lithur has 1000 of such sheets, is he going to introduce each one into evidence like he is doing? No court will allow such an abuse to go on and even one of the Judges asked him if what he was doing was necessary after doing this for a while and he was allowed to continue on that line.
I am not a Lawyer but believe me, at a point in time, if he continue on the same line of questioning, the court will ask him to move on and abandon this line of questioning haven proven his point.

1)it is normal in court to attack the credibility of the evidence not necessarily attacking its content but its gathering, collation, presentation etc can be attacked. so it seems we agree on that. the OJ simpson case turned on its head when it was shown that the Police officer - Fuhrman is the name, I think - had issues relating to racism and conduct. The evidence instantly became tainted and the bloody glove not fitting compounded the problem for the prosecution and the case fell thru the floor. it did not at anytime mean that the evidence did not show OJ killed his wife it just determined that the evidence was not credible bcos of the police officers possible bias.
2) Implying that by raising objections and having them overruled implies Tsatsu is some overhyped, useless lawyer is wrong, no court case is won based on overruled objections. so this insinuation is ignorant. if that is what made you write this article then you have proceeded in ignorance and are doing the wrong thing - maybe you should have kept quiet. objections are tools used by all lawyers in court but do not decide court cases.
3) you also claim Lithur's disprespectful attitude etc made you write this article ; how was he disrespectful????? because he chose to be firm with the witness?????? lawyers are allowed to do that. was it bcos the witnesses lawyer objected to Lithur saying he was intimidating or badgering the witness????? lawyers are allowed to treat witnesses as hostile in court so it is normal to use this recourse. this is not being disrespectful.
4)you claim Lithurs submission is repetitive and boring but the judges did at no time ask him to stop. he was asked the significance of the questioning and he explained his reasoning and at the end he was asked to hurry up so the proceedings could close for the day, this happened to Addison/bawumia on the first day at the end of day. secondly Lithur's line of question is about the repetition of evidence or double counting. This emanated from Bawumias own assertion that there was no double counting. also if you had paid attention not all the documents were the same, some were manual versus digital generated exhibit numbers, some were manual versus manual generated exhibit numbers, also there were same pink sheets with two different sets of signatures that bawumia confirmed. but all showed that there had been single pink sheets for same polling station submitted as affidavit evidence twice with separate exhibit numbers and under separate alleged fraud allegations. this was confirmed everytime by Bawumia. if this is not a significant line of questioning by Lithur I don't know what is. after all he is not trying to tell us that it happened he is trying to tell us that it happened (eg) 1000 times and this is more significant to the case than to simply say it happened and show that it happened once or twice. the fact that the justices did not at any time ask him to desist and move on is a sign that the court understand s the need for this type of repetitive submission and is not up to you to determine wether its boring or not. I found it very interesting especcialy the part where Lithur accuses Bawumia of attempting to defraud the court by submitting same pink sheets twice under different allegation with different sets of signatures, and also where he make s a statement that the cd-rom Bawumia was referring to also showed cases of double counting up to 4 times for some polling stations. this is extremely interesting and indicates where his line of questioning and reasoning s heading to. this is in no way an attitude or behavior to make you jump out of your bed and start writing in anger.

1 Furman racist attitude which the Defendants impeached him on was not the reason why the case turned on its head but the way the blood sample was collected at Furman supervision when gloves where not changed for each sample collected or i some instances where gloves were not worn.
2)I am writing an article and not a term paper and what I wrote is my personal opinion. Nowhere did I say that a case is won based on objections overruled but when it was Tsatsu and his team who demanded to know what paers Bawumiah was quoting from and Bawumiah said it was his own prepared note and they wanted to see it, then he has to turn it in as an exhibit and they cannot object to its being tendered when it was the Respondants who requested for that information and that is why it was overruled. I questioned Tsatsu's reputation because no seasoned lawyer will make such a fundamental mistake. Law 101 teaches that, don't ask a question you don't know what the answer is going to be and a lawyer with Tsatsu's over popularized brialliancy should not have made such a mistake and that was the point I was emphasizing.It's really stupid and dunderheaded to think this article was based on just the objections. Read the article again before you make a mockery of yourself.
3)I don't know what kind of case you were watching but when Lawyer Addison objected to the badgering of witness from Tony Lithur and Tony responded that shouting or loud voice is his normal way of speaking, you have to admit that was uncivilized in court to shout at a witness and when Tony Lithur accused the Petitioners for unlawful behaviour of trying to dupe the court which Lawyer Addison sought an apology from the Respondants lawyers;

1210 Court returns from recess.

Philip Addison asks counsel for the NDC to render an unqualified apology having accused them of unethical conduct.

Why do you think one of the Justice's urged Lithur to stop the repetitive attempted impeachment of Bawumia and move on? You see, Lithur came to the courtroom with a game plan to immediately attack the credibility of Bawumia because they had discovered duplicate pink sheets in the filing. Infact on direct, Bawumia testified that there had not been any double counting in the categories. That seems to be a trap lawyer Addison laid for Lithur. Lithur walked right into it and sought to impeach Bawumia and win the case with the 38 pink sheets from get go. He was licking his chops and failed to realize the witness had a credible explanation and when that is given, you move. Effective cross examination is usually short. Why didn't he simply count the number of the Pinks sheets and ask the witness whether he is aware that 38 or a 1000 of them were duplicates. If the witness disputes it, then you show him a few samples and grill the witness. More effective than what Lithur did and would not have invited the wrath of the Justice. Bawumia is smart and a difficult witness. He knows the subject matter and he is not going to give him much.
Additionally, a lawyer is as good as the last case he has won. Tsikata thinks he is a star lawyer and his presence alone will win the case. Did he not lose his last case and go to Nsawam? He seems to be grand standing with his ill advised objections and his condescending remarks directed against opposing counsel. The Court realizes this and if he doesn't stop, he will continue to lose his objections. Every lawyer knows that the Court has broad discretion to admit or exclude evidence. Why would Tsikata then try to exclude testimony and documents intended to reduce the number of polling stations at issue? How does such evidence prejudice the respondents' case? And how can he accuse opposing counsel of engaging in an unethical conduct by simply reducing their evidence? I thought the purpose of the trial is to get to the truth. Dennis, you can disagree, but don't call me a joker.

another mistake is that you say lithur was attacking the credibility of the witness, no he is not attacking the credibility of the witness but rather the credibility of the evidence. there is a huge difference here.
how could addsion have set a trap for lithur??? he lead bawumia to testify that he didn't ddouble count but the evidence they filled -affidavit evidence no less - shows otherwise. this was a huge oversight by the petitioners. Lithur insisted on rolling out all the examples of double counting he had because he was attacking the basis of the petition which Is the numbers. if they double counted then the evidence is flawed and the numbers will be wrong.
by claiming the witness had a credible explanation you are in denial of the fact (affirmed by none other than the witness Bawumia over 30 times) that the petitioners in fact submitted multiple copies of the same pink sheets under separate exhibit numbers under separate allegations of fraud. this implies that there was double counting. Bawumias explanation of it being a mistake or a result of manual vs digitally generated reference numbers is not satisfactory. it does not negate the fact that he Bawumia submitted and signed as affidavit evidence wrong pink sheets.
your evaluation of tsatsu is flawed to say the least. if he lost his last case and was imprisoned what is he doing representing someone in court. or do you know other lawyers who come out of jail and continue to appear in court to work???? his most significant case was to clear his name of the charges that were leveled against him and he has succeeded that is why he is in court today. so give the man credit he is a tough nut to crack.
