The question you should ask is whether Kpegah deliberately chose this path, knowing that his case would be struck out so that he doesn't have to produce evidence, while at the same time damaging Nana Addo's image in the court of public opinion. You shouldn't be accusing Nana Addo instead of winning on technicalities.
Ghana is a very strange place. A few years ago when Tsatsu wriggled his way out on technicalities, people claimed he has outsmarted Nana Addo as the A-G and therefore proved to be smarter, although Nana Addo only decided to handle the case himself when the Chief Prosecutor botched it. Now, a case against Nana Addo is likely going to be thrown out because it's unmeritorious and people are already suggesting Nana Addo is guilty as charged and has only been saved by technicalities. Why don't the same people also say it means Nana has outsmarted Kpegah and that the latter is not a good lawyer after all? There is too much nonsense in Ghana!

This lawyer is wrong. His write up is absolutely misleading and does not represent the present state of the law.Public interest is sufficient grounds for locus standi and a public spirited person can represent that interest and the courts of the common law jurisdictions affirm that.
This is what the law says.
Sedley J made it clear that the English Courts have always been alive to the fact that a person or an organisation with no particular legal interest in the outcome of a case might wish, and be well placed, to draw the Court's attention to an apparent misuse of public power. Thus, if an arguable case of misuse of public power could be made out at the application for leave stage, the Court's only concern should be that it was not being made for an ill motive.
In 1994, the Courts recognised that a public spirited citizen without any direct legal interest in the outcome of the case, unlike a "meddlesome busybody", may be allowed to seek judicial review in cases which present a serious issue of public importance, R v. Secretary of State for Foreign and Commonwealth Affairs, ex parte Lord Rees-Mogg

Barrister Koramoah, you appear to have misapplied the real legal basis of the suit against Nana Akufo Addo because and as Luck rightly pointed out, it is the public interest test and not "locus standi" that should be applied. I am not a lawyer but I disagree with you because the personality involved is not an ordinary person but someone who wants to be the President of the the country. For that reason, almost every Ghanaian citizen has a public interest in him as a potential future President, particularly, should his presidential petition before the Supreme Court succeed. This technicality will not work, even if the suit lacks merit on its face value.

You see AK apologetics are deluding themselves by thinking they can go on insulting and just wish the matter away. It will not go away.
On your article last saturday, I posted that I have some correspondences which is almost like a time bomb on AK. I was challenged by one DKB to the extent that he called me unintellident.
I have sat on this information over the last three years not knowing what to do with them.If I am to release them now it will add a new dimension to this AK saga. When AK left Oxford, he settled in South London and there most of the bad things about AK took place. He had close friends at the time. I have laid hands on the documents after his friends demise. I must say reading them is not palatable. Can we kill someone twice?
---------------------------------------
I am not particularly interested in the case but if it turns out to be truthful, it must be pursued to its end because of Nana Addo's disposition after the elections ans the was Ghana is gradually becoming more lawless.

No. Now I am convinced that some people in certain professions think they can fool the rest of us by citing references and quoting things in a foreign language just to drizzle us. What is this Koramoah Supreme Court judge saying. Why is he going round to show that Justice KPEGAH has no locus standi in this case. Is he not a Ghanaian citizen who has discovered an anomaly in the system he wants to bring forward? I now know that the desperation running through a section of our society because of this case is real. Justice please do not respond to any insults or any writte ups by any legal gurus, whether the come from Britain, Australia, New South Wales or Amasaman here in Accra. Please don't give up because I have interest in the matter. And bring our all the fact, Sir, including any allegation of dead bodies in an office. Justice you have set the ball flying. Just don't talk, relax and lat the court serve your opponent with the summons. WE SHALL MEET IN COURT, NOT ON GHANA WEB.

Let us crown him instead of crucify him on the word of Judas Kpegah. Let us sing 'Abide with me' for the Judas.

This lawyer can not be more misleading. His analysis is wrong and the conclusion is even bizarre. The rules governing Locus standi has never been absolute both in the permission and the substantive stage.Public interest cases must have to go through these processes so that the court does not become the happy hunting ground for the meddlesome busybody and crank. But the courts also recognized that public interest cases can be brought by citizens actuated by public spiritedness to fight a course on behalf of society. The courts therefore allow these citizens to represent the public interest. We should remember that Justice Kpegah is not a crank or busybody and therefore that hurdle both in the permission and the substantive stage should be easy to overcome.
These case laws will help clarify the position.
Sedley J made it clear that the English Courts have always been alive to the fact that a person or an organisation with no particular legal interest in the outcome of a case might wish, and be well placed, to draw the Court's attention to an apparent misuse of public power. This issue is a national one and it will involve the payment of even compensation to people who studied law outside Ghana and without being enrolled in the Ghana School of Law not allowed by the General Legal Council to practice law in Ghana, the profession they burn a lot of candle in the night to acquire. The issue in contention are did Nana Akuffo Addo sworn an affidavit stating that he was changing his name from William Dankwah Akuffo-Addo to Nana Dankwah Akuffo Addo. Thus is there a legal document to the effect that Nana Addo Dankwah Akuffo Addo is the same as William Dankwah Akuffo-Addo.
Did Nana Akuffo-Addo attended the Ghana School of Law as a requisite for practicing law in Ghana and as also a requirement to become a member of the Ghana Bar Association.
It seems that Kwame Adofo Koramoah has been in Ghana for a long time.
We state the other day that the issue does not affect only people with legal education from Eastern European countries, but as well people with medical education from the same place. With the case with the Medical and Dental Council a person who passed his or her examination in a Eastern European country is forced to rewrite the same examination in Ghana. I am of the view that people who have been deprived of their qualification just because of the place they had their education, and that must be righted by the courts. I have not been affected because of the profession in which I am, but all those who suffered from this act of unintellectual behaviour by our lawyers and doctors must as a matter of fact join Justice Francis Kpegah in this case.
It will be said that a policeman has no locus standi to charge an armed robber in a crime because he did not suffer as a result of the crime, and the same would be said to apply to a witness in the same case. Australia has been one of the countries in the wild Pacific even depriving people of their biological children just because they happen to be Australians with dark skin.
