In a significant ruling, the High Court has ordered the Ghana Immigration Service (GIS) to pay GH¢910,000 in damages to Kwabena Baffour Asare, a Ghanaian man who was unlawfully prevented from traveling to Germany in 2022.
The court, presided over by Justice Ayitey Armah-Tetteh, found that the GIS had violated Asare's freedom of movement by detaining him on June 17, 2022, based on a stop-list issued by the Ghana Police Service. The judge deemed the detention and subsequent restriction as negligent and unjustifiable.
The breakdown of the judgment is as follows:
- General Damages for Negligence: GH¢650,000
- Compensation for Loss of Earnings: GH¢250,000
- Special Damages: GH¢10,000
- Legal Costs: GH¢50,000
This ruling sets a precedent for holding institutions accountable for their actions and upholding the rights of citizens.
