Ashaiman MP files RTI request for documents pertaining to EC boss, deputies removal

The Member of Parliament for Ashaiman, Dr Ernest Henry Norgbey, has filed a Right to Information request at the Judiciary requesting access to key documents submitted to initiate the removal of the Electoral Commission, Jean Mensa, and her deputies: Dr Bossman Asare and Samuel Tettey, under Article 146 of the 1992 Constitution.

In a petition to the Chief Justice on February 26, 2026, Dr Norgbey cited the Right to Information Act, 2019 (Act 989), emphasising the public’s right to transparency in matters of national importance.

His request includes the petition itself, supporting materials, the committee’s response, and the Chief Justice’s final report.

"The petition and all supporting documents that were presented to initiate the removal of the Electoral Commission and her deputies from office under Article 146 of the 1992 Constitution. The response to the petition as submitted by the committee. Details of the decision contained in the Chief Justice's report," he wrote.

Dr Norgbey expressed confidence that authorities would comply with the Right to Information Act in providing the documents.

The Chief Justice, Paul Baffoe-Bonnie, recently dismissed petitions seeking the removal of Jean Mensa and her deputies, ruling that no prima facie case had been established.

The petitioner, Ofosu-Appiah Daniel, alleged constitutional violations, citing instances of incompetence, bias, and actions or inactions that have eroded public confidence in the Electoral Commission.

The petition, submitted on Monday, January 27, 2025, invokes Article 146 of the 1992 Constitution as the legal basis for the request.

“By these actions and inactions, the Chairperson and her deputies have undermined the integrity of the Electoral Commission and breached their constitutional duties under Articles 42, 46, 23 and 296. Their continued stay in office poses a threat to the Ghanaian people in the electoral process,” part of the petition read.
