Mahama followed due process in Chief Justice's suspension - Hamza Suhuyini insists

A legal practitioner and member of the National Democratic Congress (NDC) communications team, Hamza Sayibu Suhuyini, has defended President John Dramani Mahama’s suspension of Chief Justice Gertrude Torkornoo.

Suhuyini insists that the action was constitutionally grounded and in line with principles of good governance.

Speaking on TV3’s "New Day" on Tuesday, July 1, Suhuyini dismissed claims that the suspension sets a bad precedent, arguing that Article 146 of the 1992 Constitution provides a clear legal pathway for the suspension of judicial officials, particularly the Chief Justice.

Article 146(10) states that the President, in the case of the Chief Justice, "acting in accordance with the advice of the Council of State, by warrant signed by him, suspend the Chief Justice."

“Is it the first time someone has been suspended using Article 146? It’s not the first time. So, what precedent are they talking about?” he queried.

He further referenced comments from NPP Legal Committee Chairman Frank Davies, who, in previous statements, acknowledged the constitutional basis for the President's actions while also raising concerns about the process and public discourse.

Suhuyini explained that the President’s decision to suspend the Chief Justice was a matter of necessity, not vendetta.

“Good governance should prompt any reasonable person that this is a power the President ought to exercise—especially when the Chief Justice is the one being investigated,” he stated.
He argued that allowing the Chief Justice to remain in office while a committee investigates her would compromise the integrity of the process, as those being called to testify work under her authority.

“Would you get the semblance of a fair process if she’s still presiding as Chief Justice? Absolutely not,” he added.

Suhuyini also used the occasion to praise President Mahama for maintaining a calm and inclusive tone in handling the controversy.

“That’s what happens when true and honest leadership returns. It is commendable, not on the part of the GBA, but on the part of the President. He must continue to exude that kind of accommodative nature in our politics,” he said.
