This article hits to the core of where Ghana is headed in the democratic journey. The Supreme Court is clothed to interpret the Constitution in such way to uphold its sanctity. The trajectory of the SC in its posture on the election matters is definitely not in tandem with what framers of the constitution intended. The SC should be reminded and guided that holding voters in contempt has a boomerang effect on their own integrity.

The EC derives its power from the Constitution and must simply ignore the Supreme Court where they overstep the line. The country is polarized along political party lines and the Supreme Court must show leadership.

Ghanaians duly respected and accepted the ruling of the SC in the election petition. At that time was the SC drawing extra power to itself? If "we do not learn to the right thing, speak the truth and accept the truth" cannot can definitely not prosper. God bless you Koo.
Some of us are truly amazed at the rantings of some Ghanaians who we can also see have suddenly being confronted with the fact that Process must after all be right before credible elections can be won. I personally believe the SC does not want to be embarrassed with another election petition and its subsequent ruling. The first fool is never a fool, but the second. A word to the wise.

I believe the Justices on the SC have no idea what their role is.What in heavens name are they involved in petty quabbles for? They are not there to hear and preside over every street fight, but rather support the lower courts with interpretation of the law should that rare land mark case arise.
I often read about the SC dabbling itself in cases which does not even qualify to be heard by appellate courts and I just see it as an over reach by these Justices.I believe we can do better.

Reginald Dogbe, you have completely misunderstood Article 46. Reread it and it would be clear to you that the non-interference and the independence of the EC is not a licence for the EC to act as it wishes or a free standing clause. In fact, the language used in Article 46 clearly shows that the EC independence is as far as it complies with the totality of the 1992 Constitution and any
existing laws in Ghana. “Except as provided in this Constitution or in any other law not inconsistent with this Constitution....". This means the EC actions and omissions must comply with the Constitution and the laws of Ghana and are subject to the authority of the judiciary from lower courts up to the Supreme Court. The judiciary is the only body in Ghana that has the authority to interpret the laws of Ghana and the SC, the Constitution.
The May 5 Orders did not interfere with the work of EC neither the recent ones. Had the SC directed the EC on how it should remove the names of those who used NHIS cards to register then that would have been unconstitutional. The SC only ordered the EC to present their strategy, action plan or road map on how it intends to remove such names per the orders of May 5 2015. Remember, the SC orders also made reference to EC acting within the exiting laws.
In fact, it was the failure of the EC to act on the earlier orders that has compelled the EC to require the EC to present its programme in complying with the orders.
There is nothing wrong with the SC being powerful as long as it acts within the Constitution. If democratic and constitutional institutions do not respect the authority of the SC, then the SC has no other choice but to assert its authority. You have forgotten that the EC is also a creation of the Constitution and not other way round as the SC. This is another unnecessary attack on the SC.

Mr Abu Ramadan did not produce any evidence in court that some foreigners have indeed registered and voted in 2012 with NHIS Card.
Again,if the SC has ruled that NHIS Card cannot be used like a national ID for registration then driving license is not a national ID as well, thus unconstitutional too.Driving license is a professional document but not a proof of nationality. All foreigners residing in Ghana can have one and register with it like the NHIS Card.I entirely agree that NHIS Card is not a proof of nationality like the driving license but they are far better than allowing 2 people to guarantee for somebody who has no document at all to register. How do we know if the unidentified person is a Ghanaian or not?If SC doesn't take care we shall end up in Constitutional crisis.Thank you.
