In this very short piece, this academic, has cogently covered all the bases, and exposed jaundiced partisans like Samson Lardy Ayenini and his soulmate, Kewku Baako, for deliberately trying to deceive Ghanaians with half-truths, and outright lies!
Raymond Atuguba, may not be a mind-reader or a soothsayer, but I dare say he comes close to being one; and a good one at that!
None of the headline banners that were put out by the usual pundits and media platforms; and formed the backdrop for subsequent discussions, gave us any such lucid explanations, as he has given us here, in this short piece.
Let people like Henry Kwasi Prempeh, Joy FM's favourite, and Kwaku [Azar] Asare, come out, and better educate those of us who are not firmly grounded in the constitutional Law of tjis country!

He is just dancing around in circles to confuse his readers with this needless interpretation of the latest authoritative order( I don't called it Ruling) of the SC Justices. In fact the Order of the SC suggest that the EC has limitations as to how it can go about their constitionally mandated duties. S. Osei is foolishly behaving like a horse: she has to be whipped in the butt before she comes to do the right things. Who say POWER no dey!! What is interesting here is that Raymond has been calm and submissive this time, which makes methinks his Uncle, Justice Atuguba, has warned him to be careful about how to rattle his mouth about matters of the Supreme Court. Sir John comes in mind here. By the way, Kofi you need to go back and read the apology of Dr. Atuguba.

I find his surprise very disingenuous and contemptuous because it deliberately ignores the fact that the SC barred the use of NHIS as an I'D for voting. that there are already in place a process for removing dead people and minors from the register that is not under dispute. And that the only new addition that has to be clarified and which obligation the EC has bluntly refused to comply with is the SC order invalidating NHIS card holders until they prove nationality. And last but not the least dead people can't vote and minors do grow but non nationals will remain so until they change their citizenship. And what was the swipe at the so called NDC NPP appointment of SC members for. We're they supposed to have been appointed from heaven above. And how has that determined their judgements so far. Very petty propaganda far below a Professor of Law

This second case is a complete waste of judicial time because the orders of May 5 were unambiguous.
I heard you on Newsfile shortly after May 5 Orders and I was very disappointed in you and wondered how and why you are considered as one of the fine law brains in Ghana. On that programme, you did not make sense, you did not talk law, instead you spoke English Language (lexical semantics at best).
Though this article is a bit better than what you said on Newsfile, it is still convoluted or you are trying your very best to make this simple case complicated. Analytically, your article is very weak in that area because any damn fool having knowledge of the May 5 Orders and the new orders would come to only one conclusion. That is, the Supreme Court will re-order the EC to comply with the orders of May 5, specifically, to delete the names of those who registered with NHIS cards in accordance with the law. It's very simple so do not be too clever by making it complex.
It's also very unfortunate that you attack the integrity of the Supreme Court Justices by assigning partisan political labels of (NPP and NDC) to them. As someone in the legal profession and a Law lecturer, this is very dangerous. In the developed countries your referred to such as the US their systems (democratic institutions -the Executive, Legislature, Judiciary, etc) are well developed with checks and balances that labelling SC Justices as pro Republicans or Democrats is not a big deal. In fact, even in those countries, the language used are Conservative and Liberal Justices not Republican or Democratic Justices. It is dangerous particularly in Ghana because Ghana's democratic institutions are very weak, the country divided along partisan politics of NDC or NPP, the population acts on rumours and the society in general is organised on near break down of law and order. It is even worst when you consider that this is an election year.
In fact, your own interpretations and misinterpretations are loaded with party political bias. In other words, your tagging of SC Justices as either NDC or NPP is tantamount to the pot calling the kettle black. In plain language, hypocrisy.
Having said the above, thank you for informing us that the plaintiffs through the back door reinstated some of the previous reliefs rejected by the SC in the original case in the application for clarification.

And you have not explained the why and how of this assertion. You have accused him that his article is "very weak in that area because any damn fool having knowledge of the 5 May Orders would come to only one conclusion". David, I said from the beginning that the SC May 5 Orders were unambiguous but the so-called legal experts such as Dr Atuguba that have made them complicated and encouraged EC not to comply with the orders which subsequently compelled the plaintiffs to go back to the SC for a needless clarification. Are these not the basis of my criticism?
It is also my view that the analyses contained in the article are weak because from the May 5 Orders and the recent ones, any rational person would have objectively concluded that the SC will insist on the EC deleting the names of those who used the NHIS cards and not the numerous scenarios provided in the article by Dr Atugba. He is just being mischievous.
I explained why it is wrong for Dr Atuguba to assign NDC/NPP to SC Justices and would not repeat them. Please re-read my first comment. There is no double standards because and again, I explained why in the US this would not be a problem and even there, the words used are Conservative Justices and Liberal Justices but not Republican or Democratic Justices.
I think either you did not read my comment but jumped into conclusions or you just want to pick a fight with me. Perhaps, you are here to defend Dr Atuguba.

The SC decided to order the EC as it did because they wanted the effect of their order to be felt regarding the Elections and not allow the EC to dance around the earlier as before.

He made it clear that, in his first article that the sc didn't ask the ec to delete those who used the health cards for registration.
Now, the decision by the sc now, directing ec to bring the list of the health card users dealt a blow and call to question what Atuguba wrote in his first article, denying that, sc didn't mention that, the ec should delete those names.
Really, I wonder how he went by that. Now writing again is laughable since u got it wrong in your first write- up.
