NDC are just trying to ride on backs of Ghanaians using Akufo Ado castigations. This will not work. Castigation, intimidations, court actions,abuses teasings, did not work with Buhari in Nigeria. Martin, I agree with you that the so-called judges who did not take the bribes from Anas and his team are not clean and also ought to be sanctioned. It's only in corrupt Ghana that such judges are commended for not taking bribes when in the first place, meeting a party a party to a case before a judge (ex-parte) is not allowed. They are as guilty as those who took the bribes for the failure to cause the arrest of the Anas team or report the matter to the appropriate authorities.
I also agree with you that it beggars belief that Samuel Nerquaye-Tetteh is not only a senior State Attorney but now regional head of the AG's Department in Upper West after causing huge financial loss to the state and collecting bribe from Woyome. In other words, he has been rewarded for being corrupt. I guess he could not be punished because he would have spilled the beans on the politicians who were involved in the loot, create and share enterprise. In fact, the other official at the Ministry of Finance and Economic Planning, Mr Asemani should also have been sanctioned for his role in the Woyome scandal.
They are lucky to be in Ghana. Martin, sadly not much will come out of the Chief Justice's investigations. A few judges will be disciplined and nothing will happen to the rest. The Executive, Legislature and the Judiciary are all corrupt. The fight against corruption is a joke because none of the three organs of state has the moral authority to lead the fight.

"I still think that the law in criminal trials is that relevant evidence, however, obtained is admissible to prove an event except when there is a rule of law or practice excluding it. The exclusionary rules seldom apply to disciplinary proceedings and in most civil cases. How the evidence was obtained is of no moment as long as it is available, it can be used."
Just before that, he was talking of the admissibility of Anas' evidence in court given the manner in which it was obtained. He cited two cases from the US. I must admit, I didn't follow his argument there. Was he saying that even though Anas was acting as a private individual, even he was contracted by the state, his evidence is admissible in court despite the manner in which it was obtained?
The paragraph I quoted above makes it clear that, according to him, such evidence is admissible for disciplinary action. It is the other case that I am not clear of.
Any ideas, Kofi Ata?
Secondly, even though Amidu seems to be saying that Anas' work is good, it still seems he doesn't think much of it because he is an entrepreneur (somebody working for a fee). I find the term he coins for it as sarcastic: "covert anti-corruptionpreneurs". What do you think, Kofi?
I directed these questions to you because even though you admit you are not a trained lawyer, your interest and knowledge of the law are vast. I will surely regard your answers as your opinions only.

Godd, you asked interesting questions except that I am not the best person to answer them for a number of reasons, one of which you alluded to. Moreover, my position on this case is very different. I believe the public interest should override anything and everything and that the defence of the judges is an illegal defence.
I believe that should Martin Amidu's allegation that the investigation was commissioned by the late President Mills is true, it could have some impact on the cases under investigations, particularly, the fact that some within the legal profession could consider it as an attack on the Judiciary by the Executive. Second if it's true that President Mahama is sitting on the investigations on Parliament, again that raises a question of politicians protecting politicians. Put together the Judiciary could gain some public sympathy.
On the legal side, the argument over evidential value could also be affected, especially on the subject of privacy and entrapment. Did the state set out deliberately to entrap magistrates and judges?
I also believe that that is what Amidu was alluding to but concluded that these revelations should make no difference and he quoted the authorities to support this view. I have not had the time to read those authorities and unable to comment on them.
Having said the above, I have always taken the position that, the public interest in this matter far outweighs the individual right of privacy or how the evidence was obtained. Moreover, there is no such thing as the right to commit crime in privacy. Finally, I am also of the view that in the matter of the judicial scandal,“Ex turpi causa non oritur actio” (from a dishonourable cause an action does not arise or one cannot benefit from his/her own wrongful or illegal action/s) applies. In other words, the defence of entrapment or questioning the means used to obtain the evidence is an illegal defence that no court should entertain.
I know I have not directly answered your questions directly but when you have time google the authorities Amindu cited and read them. That may help.

How can Anas claim to be a public crusader against corruption and pick and choose what the wants the public to see in his expose?
John Mahama himself is corrupt to the core and morally bankrupt, and if Anas is a true crusader against corruption in the country then it must start from the Presidency, especially John Mahama and his thieving brothers down to the Parliamentarians. No true crusader of corruption picks and chooses who to expose in a two-year covert operation. Anas' operation is a complete shame and I am disgusted.
