Talk about the refrain 'Y3ntie Obiaa', and the names of these characters pop up. And I can bet my bottom dollar that these two guys have refused to pay heed to the CJ`s recent exhortation to Ghanaians to abandon pettiness and mischief, and instead, work to move this nation forward.
Given the 'know-it-all-attitude' being exhibited by this duo, should we, perhaps, not turn over the running of the affairs of this country
to these 'Ananse-type' persons, and see how far they can take us?
Good Heavens!

In this article, I am talking about natural justice for all Ghanaians which is enshrined in the 1992 Constitution. It does not matter whether it's about NDC or NPP? That is not pretentious or 'ananse-type'.

Kofi seems to be jumping the gun once again in a matter that he hasn't got the full facts and with only little and unreliable information. He confesses that his article was based on snippets of rumours and unreliable second hand hearsay.
Based on this unreliable information Kofi has attempted to undermine the whole findings of the Apau commission because he disagree with the findings from his unreliable sources to castigate and belittle the findings of the report.
In order to further undermine the report,he quotes the Judge's answer to a question in a grey area of war.perhaps it him who is ignorant as to what constitutes a war.As much as I may disagree with the judge as to whether the conflict in question constitutes war,we have what is known as tribal wars and is acknowledged in international law.
Now if as i understand it,the report reference was to the office of the AG then if all the information necessary to form an opinion is present, then it will not be necessary to invite Akuffo in person since it was not a personal indictment but the office and more so the political climate requires circumspection in delicate matters like this.
In the circumstances even with the unreliable snippets, I think in totality the commission had done a good job and deserve congratulations rather than denigration. After all from the rumours we know that members of all the political parties have been adversely mentioned and not only the npp.

Okonko Palm, I discussed natural justice or lack of it of being judged without a hearing. That is different from the findings of the Commission. I said throughout the article that I did not suggest that the Ex-President and Nana Akufo-Addo do not have questions to answer but the fact that those questions were not put to them and given the right to respond before being judged. As Human Rights practitioner, I consider that as injustice even if the Commission's finding are accurate. I do not need to know all the details of the report to enable me conclude that being denied the right to be heard before judgement is injustice.

Natural justice is administrative law which governs peoples right and legitimate expectation against any adverse finding without due process like the right of being given a fair hearing.Commissions of inquiry are however governed by their terms of reference.
Commission of enquiries therefore cannot determine civil or criminal liability but can can only make findings or recommendations from which liability might be inferred.
So natural justice concepts don't always hold true with commissions since “concept of fairness is not a one way street” and that “the principles of natural justice are not intended to operate as roadblocks to obstruct statutory inquiries.
Unless you are being charged with a criminal or civil offense the rule of natural justice do not always operate when in the enquiry stages.

Kofi, why and why have you chosen to mention only Akufo Addo and Kufuor in your article but ignored to mention Hanah Tetteh, Obed Asamoah and Barton Oduro who are NDC members and were also not invited?
Kofi, be truthful to yourself. Before the judgement debt commission was set up have you heard of any drill ship belonging to GNPC that was sold under NPP? So why do you try to create the false impression as if there was no basis for this truth to come? So your only concern is not about the crime being committed but the process of not giving the criminal the opportunity to respond? Well, I am afraid majority of us don't see it that way. But, for the judgement debt you and most Ghanaians would not have heard of this drill ship saga and payments of millions of dollars on the last day of Kufuor's government. Nana Akufo Addo kept the drill ship secret from Ghanaians yet was singing Woyome ,Woyome whiles on the campaign trail in 2012 knowing very well that the case was before the court.
Your suggestions that if NDC thought this was a smoking gun to use against Nana Akufo Addo would backfire is not true. It will stick as birth mark on him even to his grave unless there was no truth in the sale of the drill ship or if it was sold under NDC government and then tried to shift the blame onto Nana Akufo Addo and NPP.
So, assuming Justice Apau was wrong for not inviting Akufo Addo and Kufuor but his findings were right, do you really think majority of Ghanaians are bothered? A crime is a crime. When Akufo Addo's supporters were making threats that there could be war if invited by the judgement debt commission, whom are they blaming now? The ball is now in Akufo Addo's court.

I don't know why discernible Ghanaians should waste their precious times reading this load of rubbish which is coming from a man full of himself. I want him to respond to one of the contributors who asked him why he shamefully failed to mention other NDC members who have been equally cited in the findings. The fact that Kufour and Akufo Adfo were not invited but were found to have secretly sold our drill ship at the blind side of Ghanaians and shared the money between them, does not mean they are not guilty. Get a life and stop this gimmick. Stay clear from what you don't know. You are a danger to society. Tweaaa. Characters like you. You are too forward . Lower your speed.

I'm surprised at all these baseless noises being made about the judgement debt commission.
First of all, Kofi Ata, the author of this article, who claims to be a lawyer ought to know that the commission was set up to make enquiries but not to pass judgement.
Secondly, the general public were invited to supply or volunteer information to help the commission in its deliberations.
I believe most of the commissions business was not in camera.
When KT Hammond appeared before the commission, Im sure Nana Addo Akufo Addo heard what transpired. What prevented him from volunteering any information he had to the commission, or is he too big for that?
And like I have already premised, the commission was that of an enquiry and if they come up with any adverse findings against any person and that person feels it is not right, they can go to the courts for redress.
I am done for now.

History tells me that Nkrumah put most of his political opponents in jail without given them the chance for trial in any court of competent jurisdiction. If Atta is right in his analysis of the law, then I will say that Nkrumah was not omly a brutal dictator but also a self opinionated idiot. The craziest thing that one could do to undermine the foundamental human rights of any human being is a foolish incarceration with the victims having no chance to defence themselves. The injustices meted out to Nkrumahs political opponents was gravely stupid and must be condemn by all soundly sane persons. It takes only courageous buffoons to defend that dastardly act of Nkrumah.

Nkrumah as person did not put any opposition member in prison. The security agencies did. The opinion you articulated was a western propaganda to tarnish the image of any African leader they dislike. In their jurisdiction, institutions are assigned to such arrests under the notion of national security. In Africa, leadership is personalized to such arrest purposely to defame leaders they dislike. So be careful not to be bought into western propaganda as a gospel.

Poor job Kofi, nowhere in the report or snippets of the report was akufo addo's name mentioned. The commission had problems with the AG department terminating GNPC contract with bidman and partners but made no arrangement to defend govt leading to a default judgement of $47m. What was nana coming to say? To provide reasons why the AG dept couldn't represent ghana's interest?
Nana must learn to take responsibility. Nana on every platform chastises Mahama for all the bad things happening in Ghana. Therefore as the then head of the ministry, ultimate responsibility for the lack of show in the London court must be on his head.
Nana and his followers have never taken responsibility for anything. When he lost in 2008, he blamed k4, in 2012 he blamed afari gyan then atugiba. 2016 is coming and already he is blaming afoko and Kwabena.
Nana addo is a bad leader period. Nonetheless I believe he can do a better job than Mahama. Nana is so vindictive and it appears he is more interested in getting rid of afoko and Kwabena than winning 2016.

Kofi,
I think it was an inquiry based on facts either on documents or eyewitness accounts. The commission only calls an eyewitness when it feels there is a grey area of the facts before it. It's not an obligation to call people if it feels evidence is unequivocal and unlike the law court, natural justice does not kick in here. Academics do the same around the world and so is the auditor-general in Ghana. It's not like Akuffo Addo or Mr. Kuffour has been convicted without been heard. Hence, by any measure within logic, the commission has not erred as you wanted us to believe. It is up government to accept the findings or rejected them
