Nana Nketsiah, the Omanhene of Essikadu took Lonrho to task a couple of months ago and people were all over him for questioning the intentions and the integrity of that company on the grounds of their business practices in Africa.
I know there are a lot of chiefs in Ghana who shouldn't be given any break because they are simply corrupt, useless and have no business sense but this is one chief who apparently knows or at least does his research on a subject before he opens his mouth to speak on the subject. He was the lone and hardcore voice against the dismantling of the Railways in the Sekondi-Takoradi metropolis in the Western Region in particular and the whole country in general but the political powers in power then, paid him no heed. Now all that one needs to do to confirm how right the Omanhene was, is just drive on our roads in the Western Region. Especially those roads now being used by these huge trucks used to transport bauxite, manganese and timber to the port in Takoradi. These items used to be transported by rail to the ports. Our roads have been mangled by these trucks beyond repair not to mention the atrocious accidents caused by these trucks on our roads.
I said the last time that if only we had five or eight more chiefs like Nana Nketsiah spread across Ghana with his foresight, knowledge and the gumption to stand up for what is right, things wouldn't have deteriorated to the level we find ourselves in now.
Now here we are again on the Lonrho issue and Nana Nketsiah might be proved right once again but I will leave it to the courts to do their work.

At a time when we cannot afford to pay the bonus packages of some members of our other national football teams,Mahama Ayariga,the Minister of Youth & Sports, is running around telling everybody this govt has funds set aside to hire a foreign technical football advisor,whose advice the national coach may decide not to follow! Are we serious at all, in this country? The President decides to get into the gutters,literally,to lead a clean up exercise after the country has already been inundated with Choelera,believe it or not!
Again,officials of the the Ministry of Trade & Industry bans indigenous rice importers from bringing in rice imports,but allows a foreign national to do same,and he ends up creating an artificial shortage,thus allowing him to enjoy obscene monopoly profits at the expense of Ghanaian consumers. No wonder inflation figures are currently going through the roof! A particular interest group,POTAG,is allowed to embark on a strike action,while being paid by the state!
What the hell is going on,if I may ask? This is crazy!

1. Govt's guarantee to foreign companies is not limited to giving them the assurance that their companies will not be expropriated. Govt must also assure foreign companies they will operate in a market of fair competition where the rule of law reigns supreme. The fair competition provision is being flouted in this case. Just as foreign companies should not be unduly discriminated against, so should they not be unduly favoured. Govt must make provisions to entice foreign capital into vital sectors. What is wrong in this case is not the favours govt is giving but that the favors seem to be ill-defined and offer too much!
2. An agreement signed by government on behalf of the people is a legitimate subject for wide public discussion. It's the actual case put before a court of law and the manner in which the court is handling the case that may not be discussed.
3. This court case can prove to be very vital. We shall all be interested in the defense that govt puts up. Let's hope a ruling sets a good precedence.

May I also ask if you were being sarcastic by this paragraph. "So, today, Lonrho wants the state in what is a constitutional African democracy, and a free society in which the rule of law prevails, to protect it from potential competitors - by granting it a virtual monopoly in an agreement to build a port in Ghana that flagrantly flouts the PNDC law establishing the Ghana Ports and Harbours Authority. How can that be?"
I ask because there is no rule of law in Ghana and in fact, the statement itself is contradictory because if rule of law operates in Ghana then the Executive could not have entered into an agreement that violates an existing law and the Legislature should also not have approved the said agreement.
The answer to why Ghanaian politicians and senior civil servants sign such detrimental agreement is that they only care about themselves, family and friends but not the state interests or the welfare of the people. As far as they get their cut from the agreement, that is fine, the rest can go to hell.
Sometimes, when I read about the details of such local and foreign agreements, I wonder if Ghana is being led by .... It's sad.

Many thanks indeed, Opanin Kofi Atta. You are absolutely right in pointing out the mix-up in the identities of the plaintiffs in the Sekondi Lonrho Atuabo port agreement court case in my piece - which is unpardonable.
It is a moot point whether the rule of law prevails in Ghana or not.
What I do know is that if I broke any law here, I would be hauled before the courts in no time at all - and crack state prosecutors dispatched to prosecute me.
So I live my live in such a way that if a spotlight was unexpectedly shone on it by members of our ruling elites risked by my writing, nothing untoward would be discovered to land me in jail.
I recommend that approach to life in Ghana if you are the type who questions the actions of our ruling elites - particularly those beholden to the foreign oil companies ripping us off.
As regards the future, unlike many, I am hopeful for Ghana - bleak though it might appear to some. Rome, as you know, wasn't built in a day. Good will prevail over evil eventually.
Anyhow, thanks once again for pointing out my unforgivable mix-up to me.
I do hope you noticed that I even spelt my own surname without the letter "p" in it. Never done that before. Try not to grow old if you can help it, Opanin. :)
