When the 42-year old son of Kufour (an Accountant of the International Firm, Price Waterhouse) formed a consortium in the UK to purchase a Hotel in Ghana, envious Ghanaians with No Business Acumen or Savvy, dubbed it "Hotel DE WAAWAA".
This time we have a President in the name of dullard Mahama who presided over a meeting of a Ghanaian Bank, being the MERCHANT BANK OF GHANA, over the affairs of his brother in the potential purchase of the Bank by the BROTHER.
If that does NOT constitute a CONFLICT OF INTEREST then what is??

Peter, the Prof is absolutely right. He is not asking Judges to be prosecutors and judges at the same time. What I know is that prior to a judge giving default judgement in any claim where financial or other material compensation is being sought, for the judge to determine the appropriate compensation award, the merit of the claim must be examined by the judge. Otherwise, judges ran the risk of making irrational decisions and ridiculing themselves or even bringing the name of the judiciary into disrepute.
That what he is trying to put across because for most of the judgement debts claims granted by judges in Ghana are very suspicious and not rational and for that reason no judge worth the sort would have allowed such claims, let alone award huge sums in judgement debt by default. For example, in the case of Woyome, the judge should have questioned why the state agreed to pay over and above what was originally agreed in court as part of the out court settlement. Again, Justice Apau, recently questioned the legality of one lawyer giving another authority of attorney on a land judgement claim. The judge in that case should have known that arrangement was simply made to claim a higher amount to be shared between the lawyers. I am not a lawyer but common knowledge in the legal profession.
The Prof is also right that without the collaboration and connivance of the judges, all these fraudulent judgement debts could not have been possible. The create, loot and share judgement debt enterprise in Ghana is well orchestrated endeavour between selfish, unpatriotic and corrupt politicians, civil servants, judges and individuals. That is a fact.

I do not believe that the views, opinions and conclusions expressed by Justice Appau are judgements or amount to retrial of the judgement debts cases. I have also not heard him or read that he has set aside the rulings of the judgement debts.
His public pronouncements are the findings of his investigations but not rulings or judgements. They are the outcomes of his investigations.
I disagree with you that Justice Appau has deviated from his terms of reference and sitting as a court or behaving as a trial judge. Has he charged, tried and found any individual who has appeared before him guilty? No. Of course, on some occasions, he has said things that may be controversial but that still do not make his work a court of trial.
Again, the general arguments of Prof Okoampa are accurate and facts. You mat disagree with him but he is right.

Infact, this is the prime cause of corruption in Ghana and not NDC or NPP. It is also not a matter of Akans or Ewews stealing cats. Neither is it Hearts nor Kotoko supporters. The problem is that our university graduates are simply useless.
