Mr. Prosper Tsikata, your article fails and fails miserably on two points:
1. Ghana's laws were not modeled after US laws neither did any specific article of law in Ghana derived from a foundation of law/precedence from a law or articles of laws of USA.
2. The constitution of Ghana was not constructed and or modeled after articles of the US constitution hence our parliament and judiciary could not formulate laws and interpretation respectively in adherence to anything in the US.
Yes we may delude ourselves in Ghana (depending on the wind direction and or party in power about Ghana being a democratic nation) into believing we have a democracy in action instead of rule by tribal prerogatives but that will not put Ghana on par with systems of justice in the US and or UK.
Ghana's education system was supposedly modeled after the UK system and some of our leaders even obtained their wonderful and hot air degrees from UK schools. Yet as we know, an Oxford trained Kufour and an Oxford educated lawyer Nana Akufo-Addo chose to hire a law firm in the UK to fight our battles for us on the drillship sale. What does that tell us? We cannot and must not take best practices and procedures of civilized developed nations as the standard and or measure for what it is we have and practice in Ghana. Our government and we as Ghanaians have already admitted, even if just as a way to facilitate stealing, that we are not competent at the practice of law and it shows with the various decisions--- from the drillship sale to signing of a contract with China without knowing they are taking us for fools.
You, Mr. Tsikata is wasting and or doing a disservice to Ghana by engaging in comparative analysis of our system with those of US or UK when we do not stand a prayer.

Well, i think the writer clearly stated that he was only looking at this current case "through the lens of American jurisprudence." I think both Americans and Ghanaians can trace the legal systems to the Common Law, so there are definitely lessons for us to learn. The problems is that the system is simply not working in Ghana. The judges are lazy, they dont read; the lawyers are worse, they dont even know what time it is. People should keep writing and showing the way.

Perhaps, you'd bar comparative studies in the universities. I studied Comparative Public Admin. in univ in Norway too and we compared Norway, France, Germany, UK and the US, countries you'd agree did not derive their admin structures from the Norwegian system.
With knowledge derived from other systems, one makes changes and improvement to ones own dysfunctional one, you know?
Prosper's article is timely. Those of us involved in the financial sector are presently in a state of quandary due to the lack of updated regulations and laws on Internet payment or transfers. The banks in the UK have been ordered a while ago to return to customers they had taken as insurance against the expanding Internet fraud running into hundreds of millions £ss.
