Dr Bokor's article has once again re-affirmed the widening gap between the political antagonists in Ghana - the NDC and the NPP. It is very sad indeed because such hardening of positions and vitriolic and venomous articles will only serve to entrench hatred on ethnic and political lines in Ghana.
First, Okudzeto & Co's views about the Supreme Court judgement were expressed after their personal analysis of the judgement given by the 9 judges. This was purely an academic exercise - exercising their freedom of expression. There is no law in Ghana that bars anyone from expressing his/her opinion on a court judgement. By his designation (Dr), I presume that Bokor is an academic (perhaps a PhD or honorary doctorate holder or a medical doctor). In either circumstance, he is intellectually capable of defending the judgement on points of law - according to his understanding, or at the least, presenting an argument to counter the position of Okudzeto & Co. Such is the reaction of an academic who does not agree with the position taken by a colleague on any matter of common interest. Society at large benefits from such clash of minds. Sadly Bokor failed to do that but instead, spewed vitriolic venom on the analysts, who in no small measure has enlightened Ghanaians on what the judges meant in their ruling. For that matter my respect for him has evaporated into thin air. He has failed me as a fellow academic. Shame!
Secondly, to tell Bokor the raw truth, according to the 1992 Constitution of Ghana, presidential election is not won on the polling day, if there is cause for any Ghanaian citizen (including a candidate) to suspect unfairness in the conduct of the elections. A petition against the result can be lodged. If that is not the case(and if it is the view of the Supreme Court that any exercise in pursuance of that provision will be an exercise in futility, perhaps Bokor's view too) then Article 64 is redundant and there is no need to keep it in the constitution. In other words an article in the Constitution that cannot be enforced needs not still be entrenched in the fundamental laws of the land.
Thirdly, I am not a lawyer but in my layman's view, the judgement of the Supreme Court has created precedents that, in my view, will seriously undermine our future democratic discourse. For example, the petitioners claimed that there were over-voting - that is the number of ballot papers in the ballot boxes of many polling stations after the voting, exceeded the number of the ballot papers actually issued out in those polling stations. This could mean a voter or voters voted twice in those polling stations. Perhaps they had ballot papers concealed on their bodies which they used. In all jurisdictions, this infraction leads to the annulment of the votes in those polling station. When the Supreme Court judges refused to annul the votes in the polling stations the petitioners gave hard evidence to the effect that there were over-voting,is this ruling not going to affect future elections? Can any result of a polling station in a future election in Ghana be annulled because of over-voting? Will this ruling one day not be cited in a lower court to cause the dismissal of an election petition even at parliamentary level? Will the Electoral Commission be able to enforce this common law rule since it has now become a supervening law due to the ruling by the Supreme Court. What the ruling means is that in future elections in Ghana, what used to be obvious infractions, universally acknowledged, are no longer infractions?
Again the Supreme Court dismissed the petitioners argument that where presiding officers failed to sign the ballot accounting sheet, the results there must be annulled. This clearly is the intent of Article 49 of the Constitution. Does the judgement now say that the need for presiding officers to sign the ballot accounting sheet is not necessary? If so why was that provision put into the constitution. What baffles many including Okudzeto, is that The Supreme Court is supposed to interpret what the Constitution says. Now the 9 judges say there's no need for a presiding officer to sign the ballot accounting sheet. What was in the mind of the constitutional framers when they inserted that article?
Perhaps in the context of the examples I have given above, Bokor will understand the "back to the stone age" fear expressed by Prof Frimpong.

A friend of mine who occasionally reads articles posted on Ghanaweb, including comments, once remarked that Ghanaians seem to be intellectually bankrupt because we are not able to allow clashes of the mind on issues. We rather become emotional and dismiss any lucid arguments rather with insults. Our country will never grow if we are unable to use sound arguments to win minds. And it goes further - with our poor reasoning power, we can never develop our nation. Great minds, great nations; small minds, poor nations. We see that all around us.
In my 'rejoinder' to Bokor's article I referred to Articles 49(3) and 64 of the 1992 Constitution and how the Supreme Court's decision has, in my view, made those provisions redundant. Can any person tell me the significance of those two Articles in the Constitution and what the framers of the Constitution had in mind when they inserted them?
It's a pity that out of parochialism or petty political posturing, many Ghanaians have under-played the significance of the ruling especially in the context of future elections in Ghana. I also wonder if the judicial precedents set would be cited by any other foreign jurisprudence. For example, which country will agree that over-voting has no consequential effect on their elections if they subscribe to the universal adult suffrage of one person, one vote?
