Gabby make very interesting reading, the vote of the voter is supreme according to Nana, then why is every tom, dick and harry from busia, danquah fold scheming to innocent votes annulled on untenable premise that some lazy, careless and stupid electoral presiding officer failed to endorsed fair, transparent and validly cast votes which were counted and declared righteously in full view of the voting public with party polling agents with mandates to challenge any infractions looking on with eagle eyes yet raised no objection, Which is the standard procedure. Something is actually wrong with the petition in court. More why did't the petitions bring to court the totality of the whole election result but just a fraction from areas that do not favoured them? Had they come to equity with clean hand KPMG would have resolved this issue once and for all. Gabby keep your pen busy but know it is an exercise in futility.

Conclusion: Contempt in Ghana is in the head of Atuguba, and it is invoked only when he feels insulted or challenged, not when one comments on his case.

Of course, contempt means the court should not be brought into disrepute or be ridiculed. Do you really believe that insulting a judge hearing a case as Sir John did was not ridiculing the court?
Gabby, you stated among others and I quote "The Supreme Court, per our Constitution, is the final arbiter in presidential election disputes. So in restraining itself, the proper expectation is for the Court to resist from using subjective discretion and rather exercise its powers without fear or favour in applying the laws of the land by restricting itself to the four corners of the Constitution, the electoral laws and the evidence before it". You then provide a plethora of authorities to back your claim.
Looking at the last part of the quote above, are the authorities you stated not in contradiction of what you claimed because SC cannot restrict itself to only "four corners of the Constitution, the electoral laws and the evidence before it", but also to international norms (case law or authorities) as you did yourself?
Did you get some section mixed up because at one point you were referring to a petition in Uganda but finished it with Kenyan Supreme Court. Should it not have been the Ugandan Supreme?
Your view of what constitutes justice as far as the verdict of SC is concerned is not surprising because that is what both NPP and NDC supporters do. Their justice is dialectically opposed. Justice to NPP is a decision in their favour whilst justice for NDC is a verdict in their favour. Will justice for both be a rerun? For me that would be injustice because my justice is either, yes or no. My justice is not dependent on where the axe falls but as long as the axe falls and the axe must fall.

I am just being facetious here, trying to assert that the whole idea of contempt as applied by the SCOG is fictional......
As regards the statement that Atuguba was being selective and hypocritical, I can report to you that I tested it on a judge here last Monday during a personal injury pretrial, and no-one charged me with contempt.
Good judges are amenable to aggressive advocacy and don't go about scouring the newspapers for criticisms against them in order to cite for contempt; that sort of behavior amounts to using inadmissible hearsay in a contempt witch hunt.
Regarding Gabby's article, I think it is rather pedestrian if not altogether infantile. He fails to do any good analyses with the numerous cases he cites, many of which speak against his very proposition.

Apparently, this relatively young man (he is not 50) who has come to dominate political commentary in Ghana is not done with Ghanaian politics at all. And we have not heard him withdraw his statement of not longer being interested in Ghanaian politics.
I hope Ghanaians don't let people like Gabby continue deceiving him. This man is a partisan politician, pure and simple. He just wants his tribesman, Akufo-Addo, to win. Pure and simple. It is politics of tribalism, personal gain and glory. Nothing more than that.
