I have yet to see such an article surface. Such an article would not have a single reference to political parties, but would rather focus on the content of the Constitution and the role of the Electoral Commission(EC). The EC and no part of the EC is above the law. That is what is being tested, nothing more. The closing statements should prove to be quite interesting. However, not a contributing factor. The closing statement that mostly references the Constitution is the one that I will be interested in. as a parting shot, and my only shot, I do not perceive that that closing statement will come any so-called "luminary".

Dr Bawumia has told the Supreme Court that he does not have a single shred of protest note from any of the NPP polling agents that were at the 26,002 polling stations on Election Day
Dr Bawumia read vividly and in clear voice that if a presiding officer at a polling station does not sign his/her name on the pink sheet, it does not nullify the results.
Dr Bawumia has adopted throughout the court proceedings is, “You and I were not there, so we cannot tell what actually happened on voting day.” If you were not at a polling station on voting day, how then are you able to deduce that a figure that has been cancelled by a presiding officer still stands? Again, if you were not there, how are you able to conclude that when the figures of the number of voters are different from the words the figures supersedes the words?
Dr Bawumia wants the court to examine the pink sheets from areas won by President Mahama and throw the votes away, but he has shielded the pink sheets from areas won by Nana Akufo-Addo from review.
Dr Bawumia has made series and series of mistakes in his evidence gathering and wants those mistakes to be taken into account in throwing away the votes of over 4 million voters

You really believe that Afari-Djan announcing to the world that he did not know what over voting was did him credit or that non-signing of pink sheets was no big deal or that deliberate falsification of official documents can simply be wished away as "transpositional errors?"
In any document where numbers are enntered, the figure is entered first and THEN the words. Frankly, this petition has not only shown the fraud in our electrol system, it has also shown what a very high percentage of educated illiterates there are in Ghanaian society!

Again, you failed to mention Lead Counsel for the EC, Mr. Quarshie Idun for particular praise for the way and manner he handled himself. But, rather conviniently, you chose to hilight Tsatsu Tsikata and Tony Lithur in a very negative way and put a gloss over Philip Addison,s equally unacceptable behaviour in a light way. NPP supporters have to accept that NANA ADDO lost the 2012 elections and he has admitted it long time ago but does not want to tell his followers that he lost the election. People of Ghana , I will like to tell you all that , "THERE IS NO PERFECT SYSTEM " in the world. You can even see the number of mistakes that Addison and Co. did showing that there is no perfect system on this planet that we are living. Bawumia , confessed that they filed 11842 but when KPMG cross checked, it was less than that so you can see that the case will be on the other way round as people in Ashanti have even kept silence because they know it was not their way this time round. But I like it the way they took the whole thing to the Supreme Court which has highlighted a lot challenges faced by the EC. Thus , reforms will be out to check on these challenges faced by the EC. To end , I will like to tell all Ghanaians that, they have to pray for Ghana not a particular party to come into power by all means. Ashantis who support NPP should know that there are other people in Ghana who also vote and they should not regard other tribes as been minor. Kofi, once again an illuminating take on proceedings and some interesting insights. I just want to focus on the question of pdf.
My question is: MUST Dr Afari Gyan KNOW what pdf is? Why is such knowledge relevant to his credibility? whether he actually "Knew" but chose to be "economical with the truth" regarding such knowledge, what is the weight of that in the overall scheme of things? Can we liken this to say Dr Bawumiah's glaringly false statement about knowledge of Owusu Afriyie's declaration of NPP victory and encouraging his supporters to were celebratory attires to church on the following Sunday?
Here is my own take on the issue of pdfs. I personally would answer in the negative if you asked me if I know what pdf is, and here is why: I am from the old school and am averse to the use of abbreviations without first stating the terms IN FULL. Is it possible Dr Afari Gyan is of a similar mindset? This is very common of academics and people who have such attention to intellectual detail that dotting i's and crossing t's are part of their everyday existence.
I have a colleague professor, well accomplished and of similar age to Dr Afari Gyan who is in the habit of saying to me, when my doctoral students submit their PhD thesis to his office: I am sure you have gone through this final work with a "tooth comb".
I for one do not see Dr Afari Gyan's answer as a falsehood. Counsel Addison should never have assumed that Dr Afari Gyan would know what his abbreviation stands for- after all we are in a court of law, and dealing with technical matters. PDF could easily mean 'PIECE OF DEAD FODDER' for all he Afari Gyan cares.
In my opinion, what Addison should have done was give its full name and describe the type of document, then (if you like) use the abbreviation. IF after that Dr Gyana said he did not know what Addison was talking about, then I would be the first to condemn him and to question his credibility as a witness in the case. But that is far from the case here, and I would side with Dr Gyan on this one.
To add a twist to the issue and to see the other funny side of it: As we all know now, even counsel Addison himself apparently DOES NOT KNOW MUCH ABOUT pdf!!!
Isn't it ironic that the same person who (pompously in my view) sought to discredit the witnesses' credibility and to make him look ignorant of something that he (counsel) was presenting to the witness, himself turns out not to know that there is indeed software which allows ANYONE to EDIT pdf documents? Now we are talking about pdf as defined by you (not the portal of the defence force), see what I mean?
As someone with sound and detailed knowledge of the law and how it works (whether you accept that or not), I am sure you will agree with me that this matter of pdf and Dr Ggyan's credibility can be argued successfully in his defence that he did not know the meaning of the abbreviation used by counsel and surely, he is NOT obliged to know what any abbreviation means unless it is used, and seen to be properly used in the right context.
In this case, you and I can only guess what was on Dr Gyan's mind, but if indeed he thinks like i do, then I can tell you, he wanted counsel to tell him exactly what he meant by pdf and I can see absolutely nothing wrong with that.

For example, in Equality, RES was commonly known to represent Race Equality Scheme but within the defunct Regional Development Agencies, RES meant Regional Economic Strategy. In the same way, at work HR meant Human Resources but when I did Human Rights at LSE, HR in the Center for the Study of Human Rights meant Human Rights, whilst it meant something different in within the same institution, especially, in the Human Resources Department.
Having said that, in view of what transpired in court regarding this subject matter, I expected Afari-Gyan to have known what the pdf in question was. I know Afari-Gyan sometimes sought to belittle Addison with his cheeky responses and probably that could be one of those dismissive answers. However, if Afari-Gyan genuinely did not know what pdf was, then fine. On the other hand, if he knew what that pdf meant but deliberately decided not to know what pdf is, then, that has implication for credibility as a witness. That was the thrust of my argument.

I think some of the comments above had addressed the confusion on the twenty seven and zero issue.Afari Djan was only reading what was on the pink sheet.There was no doubt that the judges were over generous to Addison and the petitioners so they were allowed to escape with murder so to say.
The unkindest cut of all was after allowing Afari Djan to bring out a question which the judges were seeking from him,the judges then allowed the petitioners to go wild and to seek to punish Afari Djan for daring to brig up something they wish he didn't.The question then veered to him as a person and matters outside the petitioners claim and the relief they were seeking.
I would have thought the judges and the ec lawyers would want to protect him from the irrelevant questions from Addison and who keep threatening the judges that if they want him to stop making his case ,he would stop.The judges wouldn't want to be accuse of bias more so to stop the petitioners from making their case and therefore allowed Addison to take Afari Djan on for an extra two days when they had indicated that they have closed their case.
Not that those two days yielded anything substantial but Djan was harassed for an extra two days because of the failure of the judges to intervene.

Mr Ata Kofi, please be factual. The witness did reinvent numbers of any kind. I stopped reading your piece when I got to this point. The witness was asked to read what was written on the pink sheet. The Presiding Officer had written 270 in words but twenty seven zero in letters. And he posited that the Presiding Officer may have had difficulty with his spelling, prompting one of the Judges to ask why the EC employed illiterate polling station staff.

It is not uncommon for dyslexics to use other means to record things in a way that they can understand better. This in fact, COULD have been one such occasion. Sadly in our Ghanaian school system, it is only now that dyslexia is being recognised and students who hither to were regarded as "stupid" or poorly literate are now better understood.
For the information of our general readers - Cher (musician and actress), Tom Cruise (actor/director), Lord Heseltine (British politician) Winston Churchill (former British Prime Minister) are or were all dyslexic and there is nothing wrong with being one except that it comes with a difficulty mostly in translation of language and writing which ought to be recognised. They are certainly not illiterates and if anything many dyslexics have accomplished a lot in life.

I have warned time and time again that most did not gather the luxury to watch the live telecast to the fullest, but would be quick in writing all sorts to suit their own intake based on the constant stream of media bias we often read in here. That is scientific and I wonder why Kofi can't appreciate this.
Number 2, that 270 thing is trivial and the explanation is that when petitioners are claiming that their case is based on the face of the pink sheet, how do you expect Afari Gyan to mention a phrase differently from what was written on the pink sheet when a direct question has been put him to utter them as he sees it? It was not Afari Gyan who voluntarily mentioned those figures in words and numbers. He was asked by Addison. I would advice Kofi Atta to cross check his facts with individuals from both sides before coming out with his opinions because clearly your evaluation of Afari Gyan in there on several counts is deficient accuracy or lacks the full facts

Afari-Djan did not do himself much credit with his answers on over-voting, biometric verification and duplicate serial numbers. Addison was badly let down by his IT and general logistics support. It is almost certain that the EC has done something to the Voters' register since December 8 2012.
What does it take to make copies of and sort simple documents into appropriate categories? Addison's IT people failed miserably. He had prepared questions on the basis of wrong technical information and found it difficult wiggle himself out of them.
And there was KPMG. When a company that deals with statistics is asked to count documents, what is so hard about counting and categoorising the documents into legible, illegible, titled, untitled, and so on? Isn't that what statistics (population) is al about?
It really shows how deeply into the pits our education system has sunk. If these our IT gurus if the 21st Century, then Ghana is in very serious trouble. The near mass illiteracy is what is displayed on this forum every single day.

How can the judges accept the false 'evidence' which Addison tried to use to trap Dr Afari-Gyan?
The fact that Addison persistently tried to use deceit to achieve his ends and was caught out casts serious doubt over the validity of any 'evidence' he produced. Dr Afari-Gyan refuted the claims Addison made and in the end said he did not see any reason to change the results he declared. This statement alone puts paid to any attempts by Addison to get him to admit that the final election results were flawed.
Dr Afari-Gyan's reputation has emerged intact, despite all Addison's efforts. He has maintained a consistent position in the post-election wash-up meeting and in court. He made clear that there were problems in organizing the elections in terms of staffing and the performance of temporary staff engaged for the exercise. He explained clearly how mistakes could arise, and how measures had been put in place to minimize and eliminate these.
Let us not forget that this is a highly experienced electoral commissioner who has conducted 6 elections which have been won by both major political parties. In addition he has considerable international experience.
Addison's antics have undermined the case of the petitioners. His integrity is questionable, and he and Bawumia could be liable to a charge of perjury.
It begs the question: the petitioners told us that they had cast-iron evidence of fraud and manipulation in the elections. So why did Addison have to resort to deception to prove his case?

He has 34 on his voters id card now .but he is 36 yrs i hope u undertand this basic logic... since you have the feeling that Addison did not check some of his facts well before asking questions on them , i think you should also check your facts well before writing for the general public to read . i can recall that in the course of the cross examination ,Mr addison himself realized that afari gyan did not reduce his age ..
