In any civilised country like UK and other countries of Europe, Justice Atuguba would have declared his interest in the case and asked to be excused.
Perhaps you are comparing it with the US system where conserative presidents ALWAYS fill the Supreme Court with their favourites, to rule controversial cases in their favour.
If you have been on planet earth so far and been watching the proceedings at the Ghana SC, you would have noted the open bias of Justice Atuguba. He is not only biased but, he is also fumbling with his pidgin English.

This man is deteriorating too rapidly.Somehow his fanaticism had taken premature toll over his sense of judgment. He appeared on this forum a respectable voice but the sudden plunge of his reasoning will be for the Psychologists to analyze.Any informed observer will know that though the judges have their political affiliations they will rise above that when it comes to giving judgment in line with their solemn oath to do justice.Baffoe Bonnie is a known Npp and as for Dotse he was a known card holding member. That does not mean he will rule for the npp. With Atuguda as the panel president he has the responsibility of controlling the proceeding and therefore the right be to give directives now and then. The way you see things might be due to problems with age !wake up and start thinking logically again.

The chief Justice did not include herself on the panel because one of her blood relatives is married to a top member of the NPP. That is called principle. Atuguba's direct nephew had just been appointed secretary to the president. That was an open appointment. The judges may have their private inclinations to the political parties, even membership. As long as they have not appeared on political platforms, you cannot use that against them.
When Tsatsu started calling Dr Bawumia dishonest for not just cause, the judges should have stopped him. He went on to impute criminality to the petitioners' counsels. It was only when Addison referred him to his past that Atuguba reacted by declaring "the mudslinging is now even!" That was unbelievable! Not even in a magistrate court in any civilised country will you hear a magistrate make such a remark. That was my point and it has been a topic of discussion all over the world. Ghana's judiciary used to have a very high standard. That is why Ghanaian judges have been sent on assigments to Kenya, Gambia, Zimbabwe and some Caribbean countries in the past.
That is a standard worth maintaining.
That is why I still cry fro my beloved country!

Kobena, the basis of your argument is based on conflict of interest. What is more of a conflict of interest than a direct membership of a political party. The Ghanaian cultural set up is such that on the basis of your argument almost all the judges will be disqualifies.Do you recognize that there is a direct cousin of Akufo Addo on the panel? Not withstanding the relationship i don't think she is going to rule based on that. The petitioners recognized this difficulty that was why they abandoned their initial observation because on your basis they will all be disqualified. Some work at Akufo's chambers and there were blood relations as well.I will vouch that that will have no bearing on their decision and I trust on that.
Sometimes I am worried about people who should no better throwing reason to the dogs.If we don't trust the judges to do the right thing then Ghana will be the loser. For elites like you to join the crowd in making all these allegations without basis, is unfortunate.
In the true spirit of Ghana lets oppose and criticize when it is deserving but some of the attitudes seem to me like it must always favor us else there is bias.I have not been happy with some of the decision as well but I don't think that is reason enough to impute bias. The concept of bias is that justice must not only be done but it must be seen to be done. I don't think that concept apply here because the fear is balanced.

I am sure by "direct membership" you meant Justice Gbadegbe. Someone cast insinuations and he denied that and as I said, "unless someone is seen on political platform", you cannot in all fairness, pin him or her with political party membership.
You may remember that before the 1996 electtion a lady pedriatriction went to the Police Hospital from an NPP rally directly with party colours and all that. She was called to an emergency and managed to save a child's life, but was later sacked from the hospital. That was a clear breach of medical ethics and although Ghana lost a competent professional to South Africa's gain, the general consensus was that "she was in the wrong" because she went to the hospital with pary parnaphenalia.
I am not aware of Akufo-Addo's direct cousin on the panel, but if she is I would hope that her judgements are not clouded by that. My problem with Atuguba however, is that he let things go out of hand by not calling Tsatsu to order. Tony Lithur's hurling a document across the court room was definitely unethical. And frankly, some of the decisons have been very strange indeed.

We thank God for the calibre of people who represent the supreme court on the election petition. They worked patiently to bring the hearing of the petition to an end successfully. Ghana is our nation, we are peaceful people and if we want maintain peace, re election will not help at this time, it will cost us spending more money. If the supreme will be bold to say that there had been irregularities but for peace to reign in our country, if all of us will allow Prez Mahama to finish his term and after his tenure, Nana Addo will be sworn in without another election, I believe that this will neutralize any venom that someone may have prepared to disturb the nation's peace. When this happens the members of each party will be happy and live peacefully. I am not teaching the supreme court but we are all working together.
As they waste their time warming the supreme court benches, they forget about the next election which NDC is seriously preparing for.
