His argument is, if there were objections from NPP party agents over pooling station results, did they put in official complain by completing the complaint form? That is my understanding and not delegation of responsibility or duty as you are trying to impugn in your article. To say the least, your article is very misleading and misrepresentation of Tsatsu and what has been happening in court. I hope you are not a lawyer but if you are, then, it's very serious.

Part of Tsatsu's case is that the party agent had the opportunity to raise their grievance at the “material time” and failed to do so. There were arrangements in place for their grievance to be addressed and any anomalies corrected at the “material time” as happened in Adjoa Sarfo's case. However the NPP party failed to raised any concerns regarding the anomalies etc and some even went ahead to okay the results by appending their signatures .
It comes across to the independent that the NPP complain was an after thought.
The EC's case is that if the said concerned had been raised at the “material time” by the party agent as part of the checks put in place and agreed by all parties then their concerns could have been addressed as it was done in Adjoa Sarfo's case.
I agree with you that party agent to organise election but that is not the issue at stake

Together, counsel for the respondents must have asked up to fifty questions about polling agents at the polling stations.
Which Ghanaian does not know that in most villages in the Volta and the three northern Regions, polling agents always favour the highest bidder, usually the NDC. Weren't Dr Ohene and his friends from Accra badly beaten in the Ho area in 2008?
That is why parties like the CPP don't even bother to appoint polling agents in some regions.
Apart from trying to impugn Dr Bawumia's integrity on numbers, I don't believe he has made a dent in the validity of the proponent's case.

The author painstakingly drew attention to Tsatsu’s inept cross examination of a petitioner; and Tsatsu’s calculated and misguided attempt to rest the failings of an Electoral Commission (EC) on the shoulders of Party Agents.
The author rightly pointed out the distinction between the roles of a Party Agent and a Presiding officer (an agent for an Electoral Commission) during an election.
The point is that The Electoral Commission allegedly failed in its duty to ensure the accuracy of election results at the polls. It is the Electoral Commission and its agents that are paid by the tax payer to ensure that the rules governing any election are correctly followed at the polls.
Poll observers such as Party Agents have the right to raise objections about the conduct at the polls, if they have reason to do so. However, a missed opportunity by an observer to draw attention to an error during counting at a poll does not absolve the EC from its duty to correct an error or ensure election rules are observed by all participants.
The onus for the proper maintenance and enforcement of the rules governing an election falls directly in the hands of the EC and not in the hands of Party Agents.
Hence, Tsatsu’s line of questioning aimed at deflecting attention from the ineptitude of the EC to Party observers is amateurish and lacks legal punch.
A party observer may miss a trick and inadvertently append their signature to a fraudulent election result. The signature does not authenticate the fraudulent act if later the fraud comes to light.

Some of us who have seen lawyers in court on numerous occassions do cross examination can tell Tsatsu might be a great Law Professor but he is not a Trial Lawyer. Trial lawyering is a specialty Tsatsu has no clue about and he is acting in court like a dog chasing its own tail going in circles.
Atuguba has to rescue Tsatsu on many occassions and it was sad when Tsatsu asked asked a question about IC and that Bawumiah rather corrected him when it came out Tsatsu had no clue what the IC is.
Tsatsu has asked many open ended questions that have given Dr Bawumiah to make statements and every trial lawyer knows that, you don't ask a Witness questions you don't know what the answer is going to be neither do you have to ask open questions with WHAT, WHEN, HOW suffixes and Tsatsu has done that in abandon at one time even asking Dr Bawumiah about his opinion, a NO NO in law 101 that even a first year law student can tell you.
Anytime he makes such mistakes, instead of telling Dr Bawumiah that he has answered the question asked and NO STATEMENTS IS NEEDED, because he has no Trial experience, he tries to cut Dr Bawumiah off with another quick question and that is not how it is done.
It's sad to see his supporters who have no clue what is going on praising his failed cross examination. After twelve days cross examining Dr Bawumiah, it has come out that Tsatsu vaunted luminary legal mind is just a mirage. Tsatsu will not even succeed in USA as a Traffic Ticket lawyer, he is that horrible.

The common law Hagan is relying on relates more to the election process than the role of the electoral agent and the duties expected of the agent in the conduct and transparency of the elections.By law,these duties and responsibilities are very important so the agent can hold the electoral agent or the presiding officer accountable at each and every stage of the electoral process.Any over rule by the presiding officer must be documented for later adjudication.It is again important to remind Hagan that time does not wait for the indolent and whether the duties of the agent are properly discharged or not, the principal is vicariously responsible to the out come.

None of the 11,000 agents did that,since the EC directed them to go to court.We must not be only highly educated but must also have to be sencible.

Article 49 (3) clearly states that "The presiding officer, the candidates or their representatives and, in the case of a referendum, the parties contesting or their agents and the polling agents if any, shall then sign a declaration stating - a) the polling station, and b) the number of the votes cast in favour of each candidate or question; and the presiding officer shall, there and then, announce the results of the voting at that polling station before communicating them to the returning officer." The constitution gives a clear mandate to the polling agents. They definitely not mere observers. The act of the agent is binding on the principal, except the personal criminal conduct of the agent.
