"The code also seeks to avoid confusion on the figures and words written on cheques. Sometimes the figure of the amount written on a cheque may not match the words. For instance somebody may issue a cheque and may write 100 GHC in figures but in words may state just 10 GHC.
When such a thing occurs the Uniform Commercial Code enjoins that the words on the cheque must supersede the figures. This is something basic that every teller will tell you. But according to the Banking Gospel of Bawumia, when such a situations occurs, the cheque has to be nullified. Dr Bawumia stated emphatically that the cheque must be thrown away."
Is that the Ghanaian law? No wonder those people working at the Banks can easily steal. I don't know of aqny Bank in USA that will entartain such check. If you go personally to a Bank in USA to cash such a check with 100 dollars in Figures but ten dollars in words, the teller will tell you to fill another form correctly with words matching figures.
If your check come to the Bank through any medium of mail, such a check will be rejected, Dr Bawumiah was right.
Check is regarded as legal instrument and figures and words have to conform for it to become legal tender.

Ghanaians just follow theory too much without using common sense.

Such a check with two different figures in words and figure will not be entertained anywhere in a reputable Bank because it leaves many avenues for Bank Employees to steal.
Let's say you want just ten cedia from your Bank account and you write Ten in words but on the figure you write 1000 though you intended to write 10.10.
Now according to your uniform code nonsense, since words supercede figures, the teller gives you ten Ghana cedis and accepts the cheque as it is. Do you know what the teller or anybody handling that cheque can do to your account? Lets say you have 15,000 Ghana cedis in your account. A thief Bank Employer can add another ZERO to make the figure look like 10,000 and write thousand infront of the TEN you have already written on your cheque and go ahead and take 9990 cedis to make up for the figure 10,000.
If that is the law in Ghana, it is really a stupid law enacted to allow Bank employees to cheat their illiterate Ghanaian clents and you wonder why many Ghanaians don't trust the Bank and keep their money under the bed?

The essential difference between Code and Law, is that Code is one type of Law. Further, the law is always valid and enforceable, whereas Code might not always be.

Another difference is that, the Accra Metropolitan Assembly can pass codes that is enforceable only in the city of Accra and nowhere else. Example, the city of Accra can pass a code that Nobody should leave a trash infront of their houses, that is lawful in Accra and people who fraught this code can be prosecuted at city courts but that code(law) cannot be enforceable in any other city in Ghana.In essence, code rules can be enacted to bind people in certain areas whereas when we say this is the law of Ghana, it binds everybody in Ghana.

As soon as Bawumia gave this answer I put the same question to a cashier at ECOBANK Nigeri ltd. ie What happens when there is a discrepancy between the words on a cheque and the figures? According to the cashier, the amount in words is taken as the correct entry, so the issuer has to rewrite that amount in figures and sign against the correction on the same cheque if he doesn't have another checque leaflect. I pointed out this in a comment I made on Ghanaweb, long before this article. Tsatsu is a good researcher. Bawumia has come across as a person given to answering questions without deep thought, without pausing to reflect where his answer might lead him. As soon Tsatsu posed the question I sensed danger for Bawumia, but he recklessly obliged an answer. All Bawumia needed to say was that the two situations are different, pink sheets are not Bank checques. He thought he could get away with it. but I know Tsatsu has amassed a lot of meat and would raise the issue in his submission, and it is at this point that Bawumia would realise how carelessness in court can affect a witness.

I know for a fact that, you cannot write ten dollars in words and write 100 dollars in figures and take it to any bank here without the Bank rejecting it. You will be asked to fill a new form that has figures and words conforming.
If the chegue comes through mail of any medium, it will be rejected and sent back.
A pen thief and per this stupidy strict adherence of book theory, if I am working at the bank in Ghana, the law allows me to give you just GHC 10. A glib Bank employee can add Thousand in words infront of the Ten you have already written to make it look like ten thousand and if you have such an amount or more in your account, he or she can raid your account and withdraw the balance of 9,990.
Ghanaians just follow theory too much without using common sense.
PrinceWilly, try that in Las Vegas and see if any Bank will honour such a check. It will be rejected or you will be asked to make corrections.

I did not watch live video of this cross examination but read the texts so I might be wrong.
In reality, no bank will accept such a cheque but reading what the Ndc supporters have said about this issue, it seems such a chewue will be accepted in Ghana.
According to this writer, Dr Bawumiah was wrong for the answer given but Dr Bawumiah was not asked to explain a code but what will happen when such a cheque is presented to a Bank.
"When such a thing occurs the Uniform Commercial Code enjoins that the words on the cheque must supersede the figures. This is something basic that every teller will tell you. But according to the Banking Gospel of Bawumia, when such a situations occurs, the cheque has to be nullified."

That is why cheques are rejected or honoured. When a bank is faced with a cheque carrying conflicting words and figure and the bank elect to honour the cheque by relying on the words, that bank has acted within the law and any suit against it will fail. I don't blame Bawumia because he conceded not being aware of the existent of that law.

Voided cheque might not be the term to use in instances like this but dishonoured cheque or rejected but don't say a cheque cannot be voided.
Go and research and come back with your usual excuses. When you want to enter into a contract with a Bank for them to automatically pay on your behalf certain amount of money every month, you give them a voided cheque. You give a blank cheque, draw two lines on the cheque and writes VOID in between the lines and that is called voided cheque. A Banker as you call yourself should know this. What kind of a Banker are you?

There is no law that stipulates that a Bank should use the words on a cheque to cash it instead of figures. What you call law rather is CODE and that is why the word code was used instead of law. Go and find the difference between codes and laws. Codes when it comes into conflict with law takes a backseat. Any Bank that honours a cheque with two different figures on the face on it cannot use the codes to defend itself. It is called codes not laws for a reason and that is your assignment for tomorrow, MR BANKER.
