Again,the answer is simple.It is one of the characteristics of "African Democracy "-the Judiciary is not independent.

If there were FMs stations under Hilla Liman, the 31 December 1981 coup would have failed as this coup had very little to no support from the regular armed forces. Same applied to the 1966 coup. Am told had Deku and Harlley and Bawah (Gushiegu Naa) had not cut off telecommunications and the Second presidential Regiment based at Asutuare in the eastern region taken side to defend Nkrumah, our history would be a differnt one. They were kep in the dark by Harlley and Deku. Maybe, members of the Second presidential regiment alife can atest. Maybe Colonel David Zanlerigu can. FM can help prevent coup in my opinion. Accession is untested and wrong. There were 1000s of TV and Radio station Nigeria and several coups occurred. Nigeria is about 4 times the sides of Ghana. The Station argument is of merit and should dismissed as fools errand.

This is what the Kenyan SC said about some of these difficulties.
it is apparent that electronic technology has not provided perfect solutions. Such technology has been inherently undependable, and its adoption and application has been only incremental, over time. It is not surprising that the applicable law has entrusted a discretion to IEBC, on the application of such technology as may be found appropriate. Since such technology has not yet achieved a level of reliability, it cannot as yet be considered a permanent or irreversible foundation for the conduct of the electoral process. This negates the Petitioners contention that, in the instant case, injustice, or illegality in the conduct of election would result, if IEBC did not consistently employ electronic technology.
