The suit at thee Supreme Court is challenging candidate Mahama not president Mahama. Note the difference. The challenge is not related to what he did while acting as the president of the republic. Rather it is about his candidature in that flawed election which is being challenged.At the time he went to the polls, his position as acting head of state had lapsed. The present position is chrystally different from the last one. And it is the Supreme Court NOT Afari Gyan who is the final authority on the presidential election. I guess and that of parliamentary elections as well;since we have had many parliamentary election results overturned by the High Courts in the past since the return to civil rule.
So, the issue at stake is that two candidates in the past election are in the court of law to ask the Supreme Court of Ghana, the final authority on presidential elections in Ghana to look into the matter of the declaration of the election results done by the Returning Officer for presidential elections. It is the outcome of the trial that will put to rest the question of who won/lost the election. Until that point is reached, technically,there is no president in Ghana, swearing-in not withstanding. That indeed is the issue. That also answers why the "president's" legal team have not hazard any chance and are putting an appearance for Mahama.
Mr EEE that is what you should get and not to waste your time being legalese and verbose on a matter that your legal education has not helped you to understand.

It is automatically null and void without more ado; though it is sometimes convenient to have the Court declare it to be so. And every proceeding which is founded on it is also bad and incurably bad. You cannot put something on nothing and expect it to stay there. It will collapse.”
IF BY THE SAME, THE ELECTION OF THE PRESIDENT WAS VOID FROM THE DAY OF THE ELECTION, THEN HE WAS NOT A PRESIDENT FROM THAT DAY. YOU CANNOT PUT NOTHING ON NOTHING. THE PRESIDENCY WILL FALL.

Mr. Django, Ghana's 1992 Constitution states that the presidency of a president elected or acting ends on the mid-night of January 6 after the year of election. It means that the president is still in office up to 7th January after the election year. It means that any legal action that must be taken against the president must take effect from the mid-night of January 6 after the election on 7th December of the election year.
Thus a person or group of persons who fail to take action against an elected president before he was sworn in legal act is null and void.
The petitioners have a few hours between 6th January 20013 and 7th January to file their case in court and since they fail to seize that opportunity it is lost forever.
Thus any act against the president supported or entertained by the Supreme Court is null and void, and have no effect.
