One of the important questions that must be answered, especially in the light of the second of the two issues raised by the Supreme Court Justices to be decided in the election petition, is 'what is a valid cast?' Is a valid vote cast one that biometrically verified and without any obvious blemish on the ballot; or verification by other means and a ballot without blemish? If a presiding officer voluntarily or otherwise 'refuses' to sign off on the so-called pink should that act of omission invalidate the those votes which were obviously verified biometrically or otherwise? It is a known fact that after the votes have been countered at the polling stations and results forwarded to the constituency centers the only entity that order a recount is the Supreme Court. Could we come to a point where the Court can order a recount of the votes cast in those areas where the presiding officers did not sign off?

A valid vote cast is one that was biometrically verified and without any obvious blemish on the ballot, or verification by other means and a ballot without blemish. If a presiding officer refuses to sign off on a pink sheet, which is a sign of dispute, that pink sheet should be set aside and properly investigated by the EC in order to resolve all the issues around the pink sheet. The EC has no right to automatically add disputed ballots to the tally and declare the results without due process.

This article seems to bring home clearly the issues at stake and for me further emphasises the point that the petitioners are only crying over spilt milk.
If they know the rules of the elections clearly as they seem to know and were at the various polling stations (through their reps, ie represented), then why will they supervise the illegality and then turn round and want to benefit from it.
Throughout the press reportage of the elections, no where was it reported that some people were voting without verification and that some polling agents have or were registering their protest.
Again no where was it reported that some returning officers have not signed the polling sheets and some polling agents are insisting that they append their signatures.
You cannot profit from your own planned misdeeds. I will find it hard to understand why after spending hours in a queue a foolish or paid presiding officer fails to sign the sheet and therefore my vote is rejected. That will be injustice of the highest order.
