"Again, it is the suspicion of some of us that the figure given by the EC (over 200,000) as Ghanaians who voted abroad is on the high by our estimates.."
^^^^^^^^^^^^^
Many analysts err with this fact; there is a difference between REGISTERED VOTERS and ACTUAL VOTERS. The fact that we have over 200,000 of registered voters does not mean all of the them voted. It could be less than 10,000 ACTUAL VOTERS.
And remember, the court actually asked the EC to provide those who actually VOTED, but not how, when or where all came the REGISTERED VOTERS.
""The Court also by a unanimous decision granted the petitioners’ application to direct the EC to provide them with detail records of persons abroad who VOTED IN THE ELECTIONS."
But I must admit that in all, Akufo has put the EC in a corner. Even given the details of those who voted whether 10,000 or less is huge win for the NPP lawyers.
On "no surprises in court" rule, I think you have to read NPP lawyers to understand that, any FACTS about a case should be given but not all EVIDENCE could be forced to be given. But you are right about this "stupidity" on behalf of NPP lawyers. If they really want Nana to be president, why should they keep on delaying the court. Just give it out and let's deal with it.
On a whole, this is historic case and very good for law students in our country and continent.

You do not seem to understand what further and better particulars mean. And I do not think you understand the NPP objection, the respondents request and the Court's ruling beyond what you read from the newspapers that condense several pages into few paragraphs. To an illiterate, the NPP objection was not upheld by the Court. But if you understand what is going on, you know NPP gave up nothing beyond a list of polling stations that was subject to discovery anyway.

Kofi, these discovery rulings by the Court is rather elementary and were expected. It also appears that Mahama did not get everything he sought In his motion. Therefore, Akuffo Addo had a rational basis for objecting to some of the information his team was asked to produce by Mahama. This is the discovery phase in a litigation and we should not get excited anytime the Court compels a party to produce a document. It is rather routine and a way at getting to the truth.

A good article, but you erred on the EC position. Since you did not know whether the EC objected, you should not have assumed their objection and proceed to critique it. The lawyers of the EC made it known during the movement of the application that it was not yet time for pleadings during which time such requests as the NPP were making could be made. It was rather the NDC that opposed the application. Even the NPP wondered why the EC that was directly affected were not opposing and yet the NDC was. So please don't jump to conclusions regarding the EC. In my opinion it is the parties, particularly the NPP and NDC that are playing to the gallery in this case. The EC lawyers so far have been very professional and have gotten what they required of the petitioners, namely further and better particulars. Afari Gyan demanded this right from day 1.

The fact that the EC didn't oppose NPP's request for details of the qualified voters outside the country shows the EC is committed to transparency and has nothing to hide. Compare that to NPP's opposition to Mahama's request for better particulars. It clearly exposes the lack of comfortability the NPP has with that request. NPP will soon find themselves in BIG trouble in they don't cut and run because they know they don't have the correct particulars. This is something they've being running from since december 9th when the EC ask them to bring their figures. Now the supreme court has ordered them to bring it. What are they going to do next?

The potential for an historic Supreme Court judgement is enormous. The potential of the judgement is not only enormous for Ghana, but it will be viewed in the world as precedential. Not since Ghana became the first African colony to achieve Independence has Ghana held such an important world wide position. Nana Akufo-Addo et al have brought Ghana to this position. Nana Akufo-Addo is a genius and he knows where he is and what to do. He will place all the evidence in the hands of the Court and it will be their responsibility to render a righteous and just decision. Delay tactics are used in motion practice, even in the Supreme Court and we must realize that delay helps John Mahama and the NDC. With this petition the paths to the world's Supreme Courts could, after the decision to be rendered by the Ghana Supreme Court, become a golden path, based on the measure of righteous justice shown in the rulings.
