The fact that Justice William is uncle to Raymond does not necessarily prove or show that they both share the same political leanings, and even if they do, he'd be biased in favour of the NDC. I don't share same political leaning with my own siblings, some of whom support the NDC all the time and some the NPP or at times independent, even blouse and skirt! And I am an ardent pro-Nkrumaist who does not support any of the pol. parties in Ghana. Not even the so-called splintered Nkrumaist parties! So, have we not been told that Justice Atuguba was a candidate for the PFP for the Bolgatanga constituency and so can be said to be pro-NPP if he still holds his conservative ideals?! Or, the argument is that family relationship is stronger for the man than his political leaning or principles? What about his legal training and principles???? Not worth a pesewa, eh?
And then, after all, he is not the only one on the panel who has family and other relationships to the parties to the suit. Justice Dotse from the VR is known as an NPP Chairman in the region; must he also not be forced to recuse?
Sophia Akufo Addo and others are also compromised by virtue of family relationship to the NPP honchos. Paul Baffoe-Bonnie is a bosom KYC friend and roommate of Sir John at Mensah Sarbah Annex 2. I personally left the room I was sharing with Sir John so that Paul could move in when he was admitted in 1978. Should he also not be recused? Oh! Wait a moment! We have learned that his brother works in the Castle for President Mahama. Hmm, as a pro-NDC political appointee just like Raymond? So can Paul be influenced by that to throw his undoubted NPP political leaning (that's why Kufuor appointed him) to the dogs and support a decision in favour of the party his brother probably supports, in complete disregard to his legal principles? What sort of people do we have as judges then in Ghana? Unprincipled scumbags? Ah! Yes, I know some are, especially those known to be fond of taking bribes, very common at the magistrate level before they all rose up to the higher levels.
It can't get more muddy if the NPP legal team hadn't withdrawn their objection to Justice William, as the NDC could have also filed for the recusing of at least 5 of the Justices besides William! As things stand, the panel is packed with Justices who have been shown to be linked to the NPP already! So, you NPP supporters, give us a break and go away with your stupid angst, whims and caprices, convoluted mind-set, hollow arguments, and your unmeritous case.

First of all you seem to forget that the judgment will have to rely on the strength of the evidence provided. Secondly, as chair of the panel, Justice Atuguba has the casting vote if there is a tie. Third, as has been alluded to by others, at least THREE OTHER JUSTICES on the panel have strong links to people who have an interest in the case.
Fourth is the fact that the president is NOT being sued on account of anything to do with his performance or execution of his duties BUT a judicial review is being sought on account of a dispute on the vote of which he is allegedly a beneficiary. That said, the president's appointment of his nephew onto his team has nothing whatsoever to do the with Justice, NOR is it meant in any way to influence his judgment in this case.
I believe the Judge's outburst and his admonition of the NPP legal team is partly because of this blatant INSULT ON HIS (and the other justices') INTEGRITY which was disguised in their approach. Sadly, you are propagating this further and if Atuguba were to recuse himself, surely at least three others would have to do the same, don't you think?

It is not and never between the NPP and NDC ,but, when one removes 'the 'veil', then, one will see both The NPP and NDC.
You see, the test of 'The Conflict of interest' is that:it 'should be seen' and/or it 'should appear to be seen'.
Now, If I was appointed by an NDC or NPP President some years ago to the supreme Court, that alone is not Conflict of interest.
or If Nana Akuffo Addo's sister is the Chief Justice, that alone is not Conflict of Interest.
But, if Nana Akuffo Addo's sister is appointed to sit on the case involving Nana Akuffo Addo, then,
inorder for the public to have 'Confidence' and 'Trust' in the decision that will be handed out by the Judiciary, she, has to recuse her self and allow another Judge to take her position
Justice Atuguba's case is very vivid and obvious. His brother was appointed about a week ago as the Executive Secretary to the president, who is one of the respondents; and in a few days later, Justice Atuguba is found as the president or chair-person of a panel of Supreme Court Justices .
Here, if even Justice Atuguba was a former prominent NPP member or was appointed by an NPP President, the 'test of the Conflict of interest' will overlook the prevous 'NPP membership', and consider 'family relations', although, depending on each peculiar circumstance each of these scenarios could constitute a 'Conflict of interest'.
This may be one of the reasons why The Learned NPP attorneys are giving the 'benefit of the doubt' to Justice Atuguba, and had withdrwan their objection.

Justice Dotse, we learn was the constituency chairman of the NPP in the Volta Region. What criteria are we going to use? The evidence of actual bias or the perception? If it is the perception, then all the Judges must recuse themselves. They voted for one party or the other in the very same elections.

For it is the basic right of every litigant to object to an adjudicator if the litigant feels that the adjudicator might show bias against the litigant. How could Mr Justice Atuguba have risen to the position of Supreme Court Judge without understanding the principle of recusancy?
It is one of the short-comings that militate against Ghana's progress that we assume so much: a man h\as a Ph. D or something; he was appointed to this or that post at an earlier stage so automatically, he can be good in such and such a position. But such presumptions cannot ensure performance.
Mr Atuguba should put himself in the position of the litigants, if he is to do them justice. Could they regard the appointment by Mahama of Atuguba's nephew to be his Executive Secretary, when Mahama knew fully well that he was facing litigation in the Supreme Court of which his Executive Secretary's uncle was a member, a cynical way of Mahama opening a door of contact with the uncle? Was it a hidden bribe meant to secure goodwill by sleight of h\and?
It is in Atuguba's own interest to recuse himself. But instead of appreciating the need for this, he rather went and made an angry but ponderous statement from the Bench! But judges must take c\are not to expose their feelings to the public. What principle was he talking about? The principle that no-one can question a judge? That is bunkum – it was judges themselves who laid down the rules by which all judges must conduct themselves.
The observation by Mr Justice Atuguba that Ghana would “break apart” or was breaking apart was extremely prejudicial. It meant that he was minded to PRESERVE THE STATUS QUO! But the status quo cannot be preserved without throwing out the NPP petition! So Mr Atuguba had pre-judged the petition without hearing a word said in its favour.
The duty of the Chief Justice is clear: reconstitute the panel, and take this biased and ill-disciplined Justice Atuguba off the panel.
Even if he is a clever lawyer, you need more than that to be a Supreme Court Judge: you also need WISDOM and self-restraint!rejudicial remarks in court,

The law deals with factual matters and proof by evidence not the feelings of the litigants. When you rely on feelings you tend to gloss over the fact that a member of the NPP legal team has a sister on the panel or that another member was the NPP constituency chairman.

I get so frustrated with reading otherwise good articles and opinions of writers as soon as they cite precedence from other nations and their judiciary system. The fact that the SC of the US makes judgments based on party lines does not make their judiciary system the ideal. I believe JUSTICE SHOULD BE TRUTHFUL, FAIR, FACTS AND EVIVENCE BASED AND BE ABLE TO STAND THE TEST OF TIME and not ideological. The integrity of the Court is ONLY UPHELD when; judges no matter their political, religious, ethnic or sociological inclinations; are able to interpret the law of the land without fear or favor.

After reading this article a couple of times, I have been wondering why folks have any qualms about the writer exercising doubts about Justice Atuguba being on the panel set up to hear the NPP's petition challenging the results of the recent Presidential elections, let alone head or chair that panel, in the face of the reported relationship the Justice is purported to have with Dr. Atuguba, recent appointee of the President as his Executive Secretary.
Reportedly, to all intents and purposes, Dr. Atuguba, said to be the Justice's nephew, is also identified as a bonafide chum of the sitting President, Mr. Mahama, who happens to be a major respondent in that same petition Justice Dr. Atuguba is selected by the ChiefJustice to adjudicate on.
What, indeed, was Justice Atuguba thinking when he accepted to head the panel that would be hearing the NPP's petition, a very, very, volatile, not to mention, delicate legal issue at stake, given the seeming intricacies of the relationships involved?
Does he not think that fairness would be seen to be compromised, in the eyes of the NPP gurus and, in fact, all other fair-minded folks in Ghana and elsewhere?
Given his tenure, a Justice of the Supreme Court, Justice Atuguba should have displayed no iota of reticence in recusing himself from that panel, let alone heading that same panel.
Secondly, the Chief Justice had no business putting Justice Atuguba on that panel, to begin with, given the prevailing circumstances, a decision which an elementary school kid obviously would even have a hard time accepting.
Justice Atuguba should not open himself to riducule by staying on that panel for one second.
To salvage his hard-earned image, he should resign from that panel, now, for the sake of protecting himself and Mr. Mahama and to also erase any iota of favoritism emanating from a possible decision favoring the NDC.
ALL GHANAIANS WANT FAIRNESS, at this crucial time and Justice Atuguba should not be a stumbling block to giving Ghanaians a good name in the judicial circles.
A favorable decision for the NDC should not be seen as one that was cooked, prior to the case being held in the Supreme Court.
If Justice Atuguga is myopic to realize the mistake created by the Chief Justice in his appointment to the panel, he should be told by the President to step aside, if the President and, in fact, the NDC folks are serious in giving the entire nation a fair legal shake.
In this age, anyway you look at it, whether the NPP gurus are right or wrong in filing their petition, the Supreme Court has the onus of accepting their petition and adjudicating on it, however frivolous their evidence is seen to be.
Given that, Justice Atuguba should not be seen as the problem, but part of the solution of giving the petitioners a fair hearing.

On the one hand, if he sides with the NDC (which probably he had planned to do), he will be accused of returning the President's favour. On the other hand, if he votes against the NDC,(which he probably did not intend to do), he will be accused by the NDC for being ungrateful to the President and the NDC.
