The NDC and their lawyers know Mahama as the 'elected presidential candidate" can be sued in this case. The NPP in the 600,000 invalid votes are not referring to "Special Voting". They are referring to votes tallied from copies of the EC'S own "blue and pink" sheets that the EC is now claiming did not have their signatures because they were out three sheet carbon paper - triplicate if you like. The EC will have to explain how. The EC cancelled the results of some polling stations where there were more votes that ballots given out. So why would they not cancel others? they will have to answer. Just keep your ignorance and wait for answers from the EC in court

Please check my reference to arguments raised by people as to whther or not the president can be sued. My arguments, using articles 57, 4 and 5 sought to address this question.
Once mentioned in the petition, the president has the right to be represented, and counseel for the president can choose to challenge his (president's) being named in the petition as a respondent.
For now, we do not know what strategy counsel for president has decided to take. In a few days or weeks, we will know what action counsel for president will take.

Secondly the President stood election on 7th Decemeber as candidate Mahama, not as President of Ghana, otherwise there would not have been the need for him to stand.
If the EC admits gettting the basic sum of the total number of registered voters wrong, what else could they have done "wrong", especially since most of their "oversight and errors seem to have fortuitously occured" in NDC stronhgholds?
Afari-Djan is just an arrogant idiot. He sat down for some nitwits to do fraudulent things in his name. We shall sue him for "causing financial loss" for purchaing equipment that did not work on the day.
Come to think of it, it was the elderly Obasanjo, a foreigner, who went on television to explian to Ghanaians why the machines were not working. Where was Afari-Djan?

Whatever the EC did wrong will come to light, as all parties to the petition will provide evidence. Then we'll see whose evidence stands tall.
Describing someone as arrogant won't take us anywhere. Let the petitioner prove the fraud beyond all reasonable doubts - that is the essence of being in court. Name calling will not lead us anywhere.
I did not know that Ghanaians needed an explanation that machines were not working. I never knew it was so difficult for a Ghanaian to understand that a machine can fail to work.

There were certainly problems with the elections. There were genuine human errors like what nearly happened to Safoa and Ursula. So when the NPP alerted the EC that they had found irregularities, Afari-Djan should have listened and waited to look at the figures from the constituencies in a little more detail.
I do not live in Ghana, but I read about him saying "No verification , no voting." That was agreed with ALL the parties, so if that edit changes, everyone has to be informed. It was because there was no verification at certain polling stations that the voting went into Saturday.In other words, in some areas, voters were not allowed to vote on Friday without verification. So why was it allowed at ohers?
I agree with you that in many areas of our national life, we have allowed institutions and individuals to get away with slopiness. There was the EC lady on TV saying "we were in the field, we did not know what to do and each time we called we were told they were in a meeting!" That is failure of leadership. In any other jurisdiction people would have resigned or been fired. But in Ghana, they will be honoured just as Ebo Barton Odro has been honoured as Deputy Speaker for his part in dishing out state money to indinviduals for doing absolutely nothing.
Finally, NPP's tally of votes could not have come from anywhere else but the EC's own "pink and blue" forms. My only problem with them is that isntead of their General Secreatary calling a press conference to announce results, he should have sat down with a simple Excel spreadsheet and tabulated the results as they came in. That way he would have had the evidenve by Saturday afternoon. The fact that he is still at post is part of the tragedy and slopiness of Mother Ghana.
That is why I weep for my counry!

As you would have noticed, I have never stated that the president cannot be sued. My questions as to his being a respondent in this case are clear. There will be arguments for and against. Let’s see what his counsel presents in court.
Adjoa Sarfo’s case, to me, is a perfect example of how transparent the electoral system was last December, and also, it is a perfect example of the checks and balances that had been woven into this year’s elections. Adjoa was at the constituency (collation) centre. It was her duty to be there. If she could not, it was her duty to nominate someone to represent her there. Besides Adjoa, CI 75 required at least 2 party agents per collation centre. The main reason for these people to be there was to ensure that the right thing was done and no one was cheated. When Adjoa reportedly saw something wrong, she raised an objection and so the results were checked over and over until the right thing was done. It was the duty of all parliamentary candidates and party agents to be vigilant at all centres to ensure that no irregularity occurred.
In principle, Afari Gyan had no legal obligation to wait for any hours to announce the results; once he was satisfied the right thing had been done. In spite of this, he held on for some hours to listen to the NPP and even went ahead to cross-check the evidence they (NPP) supplied. When he found the evidence to be of no substance, he went ahead to declare the results. After the announcement, it took the NPP 20 days to gather their evidence. Was Afari Gyan to wait for those 20 days? I have personally gone through the petition and can tell you that am disappointed by the presentation. I think it is not worth the trouble. This is my opinion. The court will come out with its ruling.
I have already talked about the so called NVNV, which as mentioned (NVNV) has no legal backing in spite of whatever agreement among the parties. What I can add here is that at the time that some stations allegedly went ahead to vote without verification, no one knew that voting would be postponed to the next day. If they had known, I’m sure this would not have happened. If you go to www.judicial.gov.gh you will find a copy of CI75 in pdf format to download. The last time I checked, part of it was corrupted and I complained to the IT department but I think it has not been corrected yet. All the same you will be able to read all the important sections concerning the verification system. I repeat that the verification aspect had some flaws that will definitely make it impossible for the Supreme Court to simply strike out all votes without biometric verification. I see no sense in closing down a polling station just because a machine has failed to work.
Your other points are well noted. What we need in this beloved country is a change of attitude and mentality; if we do that this nation will be one of the most beautiful and peaceful places to live and work. Before returning home I had spent over a decade working in various sectors outside Ghana. What I always told my fellow Ghanaians is that if we all worked up to a half of the efforts we put up in Europe or North America, we will definitely be better off than most of those developed countries. The problem is that we work hard outside and tend to be sloppy, lazy, and irresponsible at home – especially in the public sector.

The voters understood and were back on line to vote the next day, and so there is no question about disenfranchising any voter.
We do not have the pooling stations where over-voting occurred, it appears it has nothing to do with those security votes which occurred on the Dec 4th.
Since you don't have the evidence the petitioners have and want to just infer from the snap shot of their news conference your analysis cannot be taken serious.

Secondly are you a lawyer to interpret the wording of CI 75? if you are then i wont hire you because i may end up in Jail. Are you saying that as a Ghanian citizen by birth, because it is my right to have Ghanian passport if i use cement paper and paste my picture on it it is alright to travel with it. There are laid down regulation in acquisition of passport and if you flout any of the rules the passport can be cancelled even if it is your constitutional right and that does not mean you cannot have another passport but at least you could face sanctions under the law before you get another chance. So therefore the right to vote under the constitution means the laid down rules that allow you to vote and it is not only two but first be registered to vote, have a valid ID which has to be validated through verification machine, receive a valid ballot paper and so on and on. Any break in this chain in my view is problematic.Period

I am no propagandist. Like you, I am a Ghanaian citizen in search of the truth of what happened during the elections. The SC will definitely come out with their ruling on the petition, but what I have done here is an expression of a personal opinion.
Your analogy on acquisition of a passport has nothing to do with the right of a registered and identified voter to cast his/her vote. If you asked me, I will tell you that regulation 30 (2) "the voter shall go through a biometric verification process" is flawed, and in future has to be properly supported to indicate what ought to be done in the event of a failure of a machine. What I imply is that you cannot oblige a person to do go through a verification system when you cannot guarantee the functioning of the system. And since the proper functioning of a machine cannot be fully guaranteed, that law should have provided and more sensible alternative to the event of a failure other than the closure of polling at the affected station.
Finally, for your information not all cases taken to court imply that defendants stand a chance of going to jail. I could be a lawyer but can practice law without ever handling cases that have a possibilty of having a defendant jailed. The legal profession is a wide one. There are people who practice law for 3 decades without ever stepping in a court room.

In some cases, when I have even forgotten my atm card at home, I just feed in my id card information into the system and I can withdraw money. It's a question of doing things properly. Article 30 (2) is a flawed law.

2) Of course special voting is done on a day different from the main voting day but according to the regulations the ballots are sealed, kept, and incorporated into the main voting day data, and must be done at the same polling station.
I do not have the data but yes, it is possible that around 600,000 people voted on the day of special voting. The NPP said the results of 4,709 polling stations had to be invalidated. Strike an average and you get 127 voters per polling station. Won't you agree with me that this number is even possibly a low estimate?

he said even though there are suspicions from political parties about the way the EC will conduct the exercise, she thinks it is ritual and assures the public of transparent elections.

Such being the case, it should be made a compulsory toiletry item for all free SHS students in future, to open up their comprehension skills? We can however take consolation from the fact, that not all the eleven players in a football team are forces to reckon with. Some to all intents and purposes just make up for the stipulated eleven number of players to constitute the team for the match. Fortunately he is neither a judge or counsel. Just one question, how could he have forgotten than JM had no right whatsoever to ask that people vote without the biometric machines. And voting without bio verification is wrong, period NVNV. I can also tell him that if a re-vote is conducted in those areas where the NVNV was disobeyed NDC votes will reduce drastically in those areas.

Once the EC announced the suspension to the next day, all votes without verification are null and void. They were given a chance, and they did go to vote the next day, so nobody was disenfranchised. He is trying to put dust on our eyes. For those that thought that because president Mahama said they could vote without verification, they are deceiving themselves. This is because in election matters it is only the COMMISSION that makes the decisions.
